I cant prove it either way.
Oh I didnt realise you meant it was common knowledge to people who had actually looked at the law.....that will make it uncommon knowledge then!;)If organized religion is the opium of the masses, then disorganized religion is the marijuana of the lunatic fringe.0 -

Either way, looks like this thread has come to an end.......................:idea:0 -
I am not 100% sure if its legal or not, on a personal note I back up my PC Software as well (as £300 for Windows7 Pro is a lot of money if it gts scratched to lose)
Also I have my PS2 (clleverly) programmed so that it has a built in HD with all my PS2 games stored on that - mainly to save time & space and for ease of game selection. It may well be illegal to do this but I don't really know, it's solely for my own purpose and not to make a profit or saving on.
But obviously you can see the issue why MSE would not wish to publish the methods behind either "chipping" or "copying" either Games\music\movies, someone out there will think "I can make money from this and sell copies".
I have to say AlienRik knows a lot more than I do when it comes to computer's, and whether he or I are right or wrong on whats legal or not, is not really the issue or the reason such things aren't allowed on MSE.
We may not even agree with the law on such issues, we just live by them (computer games are extortionate when you think how much it does cost to mass produce them), its just sod's law.:A:dance:1+1+1=1:dance::A

. Yes, even modifying a playstation 2 to have a fliptop lid (before the slim came out) was illegal.
WRONG
Furthermore, as a friend of mine found out after he got banned from XBL, it means that any LEGAL dlc you may have purchased, any game updates and all online benefits are also lost.
WRONG
Firstly when you buy the console you can mod it in anyway you see fit. It is not illegal, but it maybe against the manufacturers terms of use policy. Like with the Xbox 360 it's not illegal to open it, add fans, flash it etc etc. It will void the warranty and you will have broken microsofts T&C's which could result in you being banned from their XBL service. I know microsoft like to think they make the laws but they don't.
Secondly any DLC you legally bought from XBL using your 360 is legally yours and will remain yours. all you need to do is download the licenses again onto an xbox 360 that is not banned.
As for wheter making a backup or not is legal people rarely flash a 360 to play backups of games they own!!Everyones opinion is the most important.....no wonder nothing is ever agreed on.0 -

It's a legal argument that's been going back and forth for years. In the eyes of console manufacturers and some countries' interpretation the EU copyright laws, modifying a console in any way that could circumvent copyright is illegal. I modified my PS2 so I could play Firepro Wrestling R and import Kingdom Hearts 2. That same method could be used to play copies so I guess some would call it illegal.
Spain and Italy disagree. The UK only seems concerned with mod chips half the time but It's still a grey area I guess.
And my friend couldn't play his DLC because he only had one console and it kept wanting to phone home before playing the DLC. most people don't have spare xboxes laying around to get around that little issue, so it is worth noting.0 -

It doesn't matter what the manufacturers think, as I already said they don't make the laws.
There is two issues with flashing, whilst making the firmware could be seen as illegal as you are reverse engineering someone else software opening your console and modding it isn't illegal. Of course 99.9% of people who flash their console intend to use pirated games, there is no other purpose of doing it, by using pirated software then it becomes illegal.
It's no different I suppose to the cannabis smoking/growing laws in the UK, its illegal to smoke the stuff, yet you can go to a high street store and buy everything related to smoking and growing the stuff. You can be arrested and charged with smoking cannabis simply because you have gone to a smoke shop and bought a bong, extra long rizlas and a grinder!!
Your friend got banned so of course he couldn't use his DLC on that console, thats the risk you take. The DLC he has bought though is still available for him to use on a console which hasn't broken microsofts T&C's.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0 -

It's not just the manufacturers who interpret the law that way, though, it's also some countries. Although back when I was modding my PS2 the hardest thign was obtaining the fliptop case and swap magic disk because Amazon, ebay and most other suppliers stopped selling them because they were afraid of getting taken to court for selling stuff to allow modification. And the buyer seemed relatively safe as long as they didnt publicise that they modded their console...
Like I said it's a grey area that countries themselves can't agree on, but the reason i mentioned manufacturers is that they're most likely the ones to take the consumer to court to use their magical expensive lawyers to wring every penny they can from the consumer.
As for the 360 comment, I was simplifying it in case OP didn't realise that getting their console banned would stop them using DLC etc on their console. Having to go to a friend's to play DLC would be a pain.0 -
