Has my contract been breached carphone warehouse
I have been a customer for 9 years and never missed a payment. I have a contract £40. per month gives me 600 minutes and unlimited texts.
Recently I was in USA and people were calling me from the UK. Because I had exceeded the £40.00 Carphone Warehouse disconnected my outgoing calls and texts.
I believe that there has been a breach in the contract: A I never exceeded 600n minutes talk time and B I should have unlimited texts irregardless of talk time.
It also appears by them cutting my outgoing calls and texts they themselves have infact ackowledged that there ahas been a breach of contrcat by thier own actions.
I want to end the contract but they tell me that I have to only go down 1 tarrif this month and then I have to pay the remaining 9 months at the lowest tarrif of £25 but surely if there has been a breach in the contract then the contract id over? Can any one help?

Were you calling, texting, receiving texts in US ? - all of that costs a lot more overseas than the £40 would cover. Your deal with them probably has a security bar on it to protect overspend.0

As above, your acc would have flagged up due to unusual use. Seeing that there was usage overseas it would have been blocked as an automatic process.
There's no breach, its all in the T&C's, the network can suspend the service if they see unusual use.0 -

Surely suspending a contract is a breach particularlty texts which should be unlimited. They shut me down today when I paid last months bill 48 hours ago using my credit card.0

If you're out the UK and there's odd activity on you acc the network can block the sim. I do it all day long.
The phone may have been stolen, lost whatever. If it was and someone ran up a bill for £1000 over night you'd be less than happy with the network.0 -
There has been no breach of contract. You reached your credit limit and they suspended your service. Whilst suspended you won't be able to make any calls or text regardless if you've got unlimited texts as part of your package. Read the terms & conditions of your contract there will be a section about your credit limit.
Also, you will have to wait until your current contract has finished or pay off the remainder of your contract before you can get a deal elsewhere. Unless you want to have 2 contracts at the same time?0 -
Remember, when people call you, they pay a roughly normal rate, you are charged the extra amount.
Your account was closed for your protection. As above, its in your contract that they can do this. All the operator wants is you complaining about a £600 bill and refusing to pay, the operator may take early steps to prevent it.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

You sound like the guy from Carphone warehouse. If I want to have two contracts running and as you point out there is no breach then I am liberty to do so. I could only be refused if I was a bad payer and I'm not.0

It would have been far more reasonable for someone from The CARPHONE WAREHOUSE TO text or call me to check before cutting me off in the middle of a business trip in the USA0
