    when it was called AWD Home Finance between 2006 and 2009. When I worked there we gave 2 options. 1 was for a single premium PPI and one showed the mortgage with a monthly prem PPI.
    A 'Record of Suitability' was written up, explaining the advice and options given and was checked by compliance. The client signed a copy and this is kept on file. Therefore, they have a signature to show you agree that you were given this advice and are happy with your chosen option.
    I dont know if it was any different when it was CC in 2004, but if they did the above you probably wouldnt get anywhere. It was also common knowledge that most complaints like this would go into the 'black hole which is the Financial Ombudsman' never to return.
    I know this probably isnt what you want to hear but I just thought the information may be helpful.

    The FOS and the FSA dont allow bad advice to be signed off by the client as being good advice.

  • I would personally submit my complaint to the Financial Ombudsman Service. You have complained to Carrignton Carr, they have gave you a reply that you are not happy with, so submit your formal complaint to them. Its free and if you don't get anything, at least you know you tried, though playing devils advocate, if you had have claimed, it may have been the best policy you ever had!
    Though if you want an insight to the way that Carrington Carr run their business, there is an article in the Guardian, that I cannot add a link to, but, worth reading, was in march this year, just search for it and it will come up
    hough another piece of information that I understand to be true is that they actually buy leads from Moneysavingexpert.com, pretty ironic to be posting for help here, when this site actually sells mortgage leads to them. If I am wrong then I apologise, but, fairly certain

    Sorry - must have missed this thread before.

    A few points.

    As the others have said, if the intermediary subscribed to the GISC Code of Practice at the point of sale then you can take them to FOS if they continued to do so until 13 January 2005 and became FSA regulated for general insurance on 14 January 2005.

    You can also do so if the PPI was arranged in conjunction with a mortgage they arranged (which it was) and they subscribed to the Mortgage Code at the point of sale and continued to do so until 30 October 2004 before becoming regulated for mortgages by the FSA on 31 October 2004.

    It is NOT for the intermediary to tell you that you cannot go to FOS because it is timebarred. They can explain why they believe it is timebarred and they can indicate that they will object if you go to the FOS on those grounds but they cannot tell you categorically that this is the case.

    Furthermore, the rules say you should make your complaint within six years of the original event or, if later, within three years of when you knew, or ought reasonably to have known, you had cause for complaint. Unless you have had a claim declined, FOS is unlikely to accept that the three year "clock" ever started running.

    However, there are some downsides to your case. The first of these is that the Mortgage Code Compliance Board issued Good Practice notes that indicate that, in itself, MPPI is a good thing.

    This is because it is possible to lose your home if you cannot keep up repayments. The Good Practice notes also stipulate that if it is sold on the basis that a single premium was added to the loan then the applicant must be shown what the total cost of this was likely to be over the entire course of the loan.

    So if the practice described by nikkersc took place with your purchase, and the documentation was on file, I think it likely that your complaint would be rejected because the sale would have complied with what was considered good practice at the time.

    Certainly, if I were working for Carrington Carr, that would be the defence I would use.

    However, Carrington Carr should have provided you with that evidence rather than a spurious attempt to time bar. Since they haven't, I would say go to FOS.

    You probably only have six months from the date of their response or another timebar will apply and it only costs you a stamp, so crack on.

    Hi,
    I too had a call from carrington carr stating that I registered on their website. They made me book an appointment and had them over this evening. On arrival there were 2 poeple felt intimidated and went ahead and gone through whole mortgage application. They book another appointment on Thursday. I was not feeling very happy so I searched the web and I normally use MoneySaving Expert but didn't think to check them out before hand.
    I have emailed them to cancel my appointment as I do beleive that I did not register with CarringtonCarr as I've never heard of them.
    Will be keeping you updated on the outcome. The only worry is they have a lot of my personal details.Can they cause damage with this?

I have recently claimed and been refunded the premium amount + interest and I asked for the Broker Fee to be refunded £2295 as he had given bad advice. I was refunded a quarter of the broker fee and additional £579. AWD is calling themselves Carrington Carr again. They are associates of Legal and General Partnership Services and you must send your complaint to them.

    Hi all, newbie here!
    I took out MPPI with D&D Homecare arranged through AWD back in January 2005 for a 6 year period with a single premium of £7960 added to the re-mortgage. Having read some of the posts on the forums I had a look at the original paperwork and thought I wouldn't have a chance to claim as I had signed this and that and had all the reasons & recomendation documents.

    Seeing that your policy only started 3 years ago, you must have had the same documentation right? If so, what grounds did you use for your claim?

    Recently, received a letter from the solicitor who handled the re-mortgage saying we may be eligible for compensation or a refund plus interest! so maybe there is something in it after all. Damned if I want to pay them anything though!

    Advice and guidance would be greatfully received.:beer:
