The fact remains, if they sue for £500 it will be a small claims matter. They (BP) wont be able to recover their costs, only the cost of issuing.

If the OP defends the action, BP's costs will sky rocket to easily more than the amount being claimed. Again they wont be able to recover these costs even if they win.

BP made a profit of £17 billion in 2008, although it sounds like they've had a tougher time of it in 2009. However I suspect that if they do make a claim in this case they might not be too worried about recovering their costs. I'd also assume that they have an in-house legal team capable of dealing with these sorts of situations.

It may well be that they decide it's too minor an issue to bother with but don't rely on the cost of filing a claim in the Small Claims Court being enough to put them off.

Just playing Devil's Advocate here but where I live no one uses petrol station forecourts as 'long-term' car parks. Most people drive up to the pump, pay and then drive off. You get the odd person who parks up elsewhere and pops into the shop for a newspaper, sweets, fags or whatever but they don't stay parked for more than a few minutes.

I asked if the 2 cars in front were causing a problem too but the assistant said they were cars that belonged to staff.

The OP stated that the cars belonged to staff, so were obviously parked there for say 8 hours, or however long their shift was, indicating that it was a reasonable area to park in.

My local garage has a hatched area over bits where you can't park.

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

sorry but if she was well enough to walk into the shop well enought to walk over to the brewers fayre she was well enough to drive her car into the car park

if bp do fine you or whatever you cant have any complaints

That is the opinion of someone with no medical knowledge what-so-ever.

I think the bigger point is being missed in that someone knew that they felt ill and had the good sense to get off the road so as not to be a danger to anyone else.

    Well done.

    .

Or maybe indicating that they could be asked to move their cars without any problem, if necessary?

What i don't get is why people who are clearly not qualified doctors are replying as though all of a sudden they are doctors & giving their unprofessional medical opinion which means diddly squat.

That & the fact the OP hasn't returned with a reply/update so far.

Same reason why people who aren't lawyers pop up left, right and centre giving legal advice, I suppose. Case in point being the bit about BP having to prove negligence a few posts above, which was clearly written by someone who doesn't know what the legal use of the term is.

As I read it the OP only found out the cars belonged to staff after they had returned from the pub in which case it wouldn't have been obvious to his partner that they'd been parked there for eight hours at the time she parked next to them. Even if she knew the cars belong to staff she presumably wouldn't know the staff rotas so she wouldn't know when the owners of those cars were due to finish their shifts and go home. Unless of course the OP is in a relationship with Mystic Meg .
