Loss could be substantially more than £500.

What if they ran out of fuel and had to turn customers away?

Bad advice to contact BP. Let sleeping dogs lie.

Having reflected a bit, if it did come to a claim, it could be claimed that BP had [presumably] not marked the area out as 'no parking' - otherwise partner would not have left car there. And that if they expected a delivery, they had not taken steps to secure the area. And that if they desigened the filling station, they were victims of their own negligence in not providing a separate access to the filling points.

    Hi,

I would go back & take photos of the area where parked ... so can prove what signs were there, etc.

But I would not contact BP ... lets see if they come back to you ... did you give you name & address ... I wouldn't have done .... I would have got into car & driven off ...

  • Don't contact BP, let them try it on. They've got very little chance of successfully recovering this "fine" (in my strictly non legal opinion).

If they do try, my response would certainly be along the lines of "sue me"...

But i'm renowned for being a bit bolshy! :D

BP would have to quantify losses.
They would also have to show you acted negliently.

I would suggest parking a car in front of fuel pipes at a garage where you werent filling up and not notifying the staff of such was neglient. Markings or not. You should not park at garages and they always normally have a few spaces marked out for customer short term parking.

quanitfying losses. If they can show a tanker arrived, they can reasonably sue you for the lost time of the tanker, the driver, any degradation of supplies on board, any lost custom (this can be a lot as some garages close for deliveries) and any other losses - staff having to look for you.

Tbh I would suggest that if they do pursue this they will win. Personally I would keep shut until they do something and hope they dont.

The fact you managed to make it into the garage, buy water, walk to a restaurant, eat a meal etc but couldnt tell the garage staff is imo going to be what would win them any court case.

No they wouldn't have to show negligence. Just that the OP parked where they shouldn't have.

    Its basically the same thing.
She was neglient to park somewere she shouldnt have.

If she had parked in the garage somewere but it wasnt causing an obstruction or such they couldnt do much.

Either way the OP should really hope that BP don't pursue it.
