change of vehicle refused

Hello everyone, Please can you help?

I got a bit of a surprise today when my existing insurers have refused to change me over to another vehicle, from a group 11 Rover 620 to a Group 3 Daihatsu Cuore (its like a Micra).

Now I wasn't informed of this that they could do this when I took the policy out for which I paid £400.

Are there any rights that I have, as the policy is due to expire in 6 months a refund would only generate £16.

    I bet you were shocked at this. However, under the FSA guidelines, this should have been pointed out to you, or noted in your policy conditions.
    If it wasnt made clear to you when you took out the policy, did they at any point advise you to read the terms and conditions of the cover?

    If they didnt say at the start it could not be changed for an alternative vehicle, or if they did not ask you to check the terms before proceeding with cover, then you could claim you were missold the policy and get a full and total refund.

    Thanks, yes I was shocked. At the moment the brokers are saying that its simply some insurers refuse some vehicles and they cant mention everyone so they dont inform when a new policy is taken out.

    I'll check the T & C's but I doubt that anything on change of vehicle is mentioned, if not I'l write for a refund, is there any thing I can mention to get the wording correct?

    I'm not familiar with the Daihatsu range. Is the Cuore an import or modified in any way?

    Its simple contract law I am afraid.
    You entered a contract. You tried to change contract.They declined. All perfectly acceptable.

    Are the brokers saying that your new car is unacceptable to your Insurers?

    If this is the case then they wouldnt tell you that when you took the policy out. They cant say to you "oh if you change to this car, or this car then your insurers wont accept it" Did you tell them when you took the policy out that you were going to change to that car?

    However, if its a case of you not being able to change your car at all on that type of policy then they should have told you this at the time.

    If the new car is unacceptable to your Insurers, I would be checking to make sure you get a pro rata refund.

    The car is a normal car, made abroad though in Japan so is probably imported. but not modified and it was intended for the uk market and sold via the normal dealership route.

    Reason for refusal is it doesn't meet the Insurers criteria, but they wont tell me what that is?

    I didnt tell them i was going to change a vehicle later, as I didnt know.

    The brokers are saying i could change a vehicle but not this and theyre not telling me which ones either, all they do is tap the details of the new vehicle into the computer, if its acceptable then so, if not then they tell you its refused

    as for the pro rata refund i'll only get £16

    Along the lines of what penniesonly said I think I was missold so I'd like to take up that avenue or any other to get a full refund.

    Why exactly?

    Insurance is an annual contract on the info provided. Any subsequent change is entirely discretionary.

    A refund is a seperate issue and will be done in line with the normal terms agreed too.

    Some insurers don't cover imports. Even if it is smaller than your original car. Sad but true.

    Doesn't sound like a stunning broker.
    Mine would have been on the phone finding out why, and trying to negotiate a deal for the remainder of the insurance period.
