    There are no windows on that side of the house. Will try and take pictures later.

    Apologies but pictures taken from window in case neighbour sees me taking pictures and gets angry. Ours is the red brick house and pictures are taken from our nearest window to their property. Boundary wall can be seen at the bottom of the first picture. It then attaches to our home wall. Gate can be seen in second picture, it is attached to the side of our wall that, unfortunately you cannot see. If you could imagine the caravan in front, you would not be able to see this from ground level. The workmen saw in from ladder on the inside of the garden wall (ie up against the window). You can actually see rust on their gate which suggests it has been there longer than a year. The pictures are fairly deceptive as that is actually quite a wide distance between properties. The gate is actually a double gate around five foot at least in width if not six.

    Legally speaking they shouldn't have the post attached to you outside wall without your permisssion but in reality what harm does it do. There are loads of detached houses near ours that do exactly the same thing.

    Also, looking at your first pic, your garden wall wouldn't be the boundary wall as it seems to be a couple of inches within your property line.

    Do you have a gate on the other side of your house?

    I had a back passage in my last house with a steel gate attached to each side. I didnt object it gave us both more security from low lifes

    Judging by those photos cant see why you need to object

    I can see their difficulty, without a gate they have no ability to secure their own property and keep their kids/dogs in.

    As said though they have no right to do it. Personally, I'd get someone to look at it to ensure it's not connected to your damp problems and then I'd let it lie.

  • Well as I have said, I'm not going to do anything about it unless they move. I can put up with my sleep being interrupted every night when they are constantly bumping it to do whatever they are doing in their garage in the middle of the night. I should also point out that they have no children and that their house is completely gated/walled/fenced at the front/ main entrance and back. That is a side gate. Yes we have three other gates on our property, don't see why you ask? We live on a corner, the other gates are not attached to anyone else's property.

    I notice in the first picture that there appears to be a car there, so the gap is going to be quite wide. I don't see why people are telling the OP just to put up with it? She is getting distrubed sleep due to the gates being used, they ask to put a gate up, OP declined but they did anyway and they have set them back so avoid the OP seeing them. They sound like very selfish neighbours. If I came home to discover some one had drilled holes into my property I'd be pretty pee'd off too! If they were that desperate to have a gate, they could have set a post in concrete a few CM's from her wall!

    By looking at the pics, it looks like that gate has been there for a while, can you see the drip mark on the wall which has come from the rust?

    When did you go on holiday? (As that's when you think they put it up)

    I wouldn't have it anyway, I'd have them take it down and see what the damage to your wall is like, then if there is any, have them pay for it.

    Why leave it, they asked, you refused and they went ahead and put it up anyway.

    :confused: She says she thinks the gate has been up for a year but only just noticed it. If the gate was causing that much problems with sleep surely the OP would have noticed it a little sooner.

    I doubt the noise is anything to do with the gate. Otherwise the gate would have been noticed a little sooner. I would however speak to the neighbours and mention that this is the first you new of it and get your damp proof checked

    The reason I asked is that if you didn't live on a corner you'd probably want a gate on the side of your house too. I'd imagine if you were to look at the other properties in your area they'd all be doing similar things.

    I am going by this part of the OP post

    'Over the past two/three years, I noticed that there was a lot of noise coming from their back yard, waking me up in the night and at 5am. It was like a scraping and bumping coming from and along the exterior wall of our home (the room being my bedroom hence me being awakened)'

    Which would suggest the gate is the cause of the noise.
