i have to agree, this is an old and rather lame scam that can easily be avoided by simply reading the whole listing.

i seem to remember reading a thread on here a good few months back on a seperate issue where one or two cocky posters were bragging about how they don't have to read a listing because paypal will always refund them no matter what....well i hope that is the case here i really do but to those with the attitude of listings are there to be ignored let whats happened to the poor op here be a lesson to you.

for the op on the up side you have a cast iron case for fraud here and providing your not dealing with a pro con artist you should be able to get him arrested quick smart.

If he's a pro all his details will be false and you'll have a hard time tracking him down but start by getting his name and address from ebay then run it through www.192.com to see can you get a match on the address and a phone number. If you get a hit pass on the details to as many of his vctims as possible and tell them to report him to his local police for fraud, the more calls the police get the more likely they are to go and arrest him.

If all that goes well you'll have a better, stronger case for taking civil action to recover your losses but hopefully he'll get a stint in one of her majesty's hotels too, but remember it's a long shot, if he's a pro you won't find him.

i'm assuming he delayed postage long enough to withdraw the funds so paypal chargebacks are out?

In fairness though that isn't being advertised as an Iphone, so the seller isn't doing anything wrong, your right that its just an Iphone copy but only an idiot would buy it thinking it was a genuine Apple IPhone. AGain this is where it pays to read the auction before bidding.
But if anyone is thinking of buying one of these because it looks like an Iphone but is cheaper, its cheaper for a reason. You can't load IPhone apps to it, the screen resolution is poor and unvisible in daylight conditions, battery life is dismal and the overall phone is poor. Yes i did buy one as i was being tight and didn't want to spend nearly £400 on a phone, but i sold it on ebay making a tidy profit so wasn't all bad.

I was the one who reported vinney2787 and got the listing cancelled on 29th December.

I repeatedly asked him questions like 'is this a genuine Apple inc i-phone'

The only answer i got back each time was 'my advertisement is accurate' or 'read my listing and it will give you all the information you need about the item'

I had noticed that he had sold lots and lots and kept relisting the advert (and the iphones were too cheap also) so i reported him to ebay and the listing was removed and he was banned 24 hours later.

I really feel sorry for all those people who were conned by this user and the police will probaby be involved by now. I think he sold over 30 i-phones for between £300 and £350 which is a crazy amount of fraud.

I did notice the line hidden in the spec stating *this is a photo only* which was well hidden, took me about 5 attempts to see it but nontheless it is there.

Does that not have the senders address on it?? If so i know where i would be going with a van full of friends!!

Also, the end of my story is that i did not buy and went to Carphone Warehouse and relieved myself of £440 instead!!!

Hi I feel really bad for the buyer, but you have to hand it to the scammer they covered everything quite well, I have highlighted the parts that could be problematic for a Not as described claim, Very clever, naughty but very clever. Makes you wonder how successful our country would be if these guys all had legitimate businesses, some of them are Just genius.
