Oh, you definately have a case!
Ebay have a phone number for customer services dont they. Itd only take a minute to ring them.
Having looked at case i would say it breaches these conditions:
1. Wrong category. It was a picture, not a phone.
2. Excessive postage charges for a picture.
3. Title says it is a phone, not a picture.
4. You didnt mention yet whether the bundled items were in the photo, in which case this'll be the biggest breach, as they werent included.
5. Where he has written in '*' where does this refer to elsewhere in the description?
If it was recorded cant you track the address it was sent?Have you contacted the other winners? And is his address on the paypal invoice?
I'll be interested to see what comes of this case. What did he say when you messaged for your money back? Presumably it states no refunds on the auction?:AQuidcoCodes

Is the seller a business seller? If so, can't the photograph be returned under the DSRs.
Can the OP take a close look at the photo and find any "damage" (tea cup stain or such) to it which is not described in the listing, and return it by a trackable method for a SNAD dispute?0 -
He has 3 items he has brought on his profile in his feedback. Those sellers will have is address! You could always forward them the details youve got about him and see if one is kind enough to illegally forward you that info!

Hubby has recently been hankering after an Ipod Touch. When researching the best price/deal he looked on ebay.
He found a few auctions that seemed to be ending very cheaply and admittedly was a little tempted.
Though after reading all the spec info the seller listed he often came across the word 'replica'

But doesn't paypal now provide refunds where the seller is AWOL, then they pursue the seller? That's what I was imagining would happen if there was a return under the DSRs.0 -

Play him at his own game - you can even return a cut out magazine picture of a nokia 5800 to him recorded delivery to satify paypal and give them proof of delivery - heck, push the boat out and send it special delivery due to high value.
