I wouldn't like to buy food that's been put back on the shelf but I'd be mad at paying that price for 2 pies. I think M & S were correct but have sympathy for the OP.

I think if people were going to tamper with food they wouldn't go to the hassle of paying for it and then getting a refund. They would tamper with it then put it back on the shelf.

I rarely shop at m & s for food as its too expensive. When i have been in there i do find that price lables are often missing but i do then find a sa to ask the price.

I'm sure I read about a woman, in America, who did just that, not long ago.

Well, just about, she contaminated baby food in the shop and tried to take it out. She had been seen and was stopped at the checkout.

I didn't find out what she was up to, only that she did not put any of the contaminated food back on the shelf, she put it in her trolley and tried to take it of the shop. She had no baby, nor any connection with anyone who had a baby and had no reason to buy baby food.

At the time I wondered why she did it in the shop when she intended to take it out of the shop. Why didn't she wait and do it somewhere private?

Baby food is different though. If baby food is returned it can not be resold.

But your point was that someone contaminating food would then put it back on the shelf, not take it and pay for it. My response was to show that someone did just that, contaminated food inside a shop and tried to pay for it.

I did a bit of digging and if you google "Shirley Ybarra + baby food" there's lots of articles about it.

I think M&S could have been a bit more lenient in OP's case as I agree, their food seems to wander around the shelves dramatically at this time of year, and the SEL's rarely correspond to the item!

I would send them a letter in the hope rather than the expectation of a small voucher.

Sorry but I wouldn’t be happy to buy food that’s been returned. I am sure you didn’t contaminate the food but you never know what some people have in mind.

when you ate them and found they werent any good i would have taken them back and told them so and got your money back then. I did this in M&S with one of the chinese meal things.. i treated myself to it one night but it was horrible bordering on inedible.. i tipped it all in a plastic freezer bag and took it back and got my money back. i expected better from M&S food... the price of the pies is not really the issue, if they were the most delicious pies ever £8.50 for 2 would have been cheap, but for mediocre pies it is way too much...
  • When I worked at Tescos on the counter we would have a problem of people getting us to cut meat from a joint and about 1/2 hour later one of the other staff would find it amongst the freezer stuff or just shoved on the shelves - we would have to chuck it as we couldnt be sure how long it had been out (temperature/tampered with).
