Please Help
I placed some M&S pies in my trolley - was shocked after checking out -
they cost £8.50 for two. Took the items and receipt straight to customer services. They refused to refund saying that I could have tampered with the food. I was 2 metres away from the till!! Do you think this ruling is absurd ??

They dont have to take back the goods. However their excuse is a bit lame. If you wanted to tamper with it, you would have done it before paying for it!0

Sounds daft to me, if the boxes looked intact and you had not even left the store.
Were you polite. I often think that if I worked in a shop I would find it hard to stay pleasant when you hear some people talking to the assistants.
Do they not have a love it or your money back policy.0 -
That is exactly what I thought ! Its not realy the money more the principle. Supermarkets often make mistakes at the till and people decide they don't want the goods for whatever reason. I went to customer services less than a 2 mins after I had paid. Very poor customer relations - have eaten the pies were def not worth the money either. Suppose you live and learn !! Sorry but I don't.
There's no legal requirement for them to take it back just because you didn't like the price after you had paid for it.
Also, I'm sure this is not the case, but you could have tampered with it before you went through the checkout.0 -
Yes TubbyFunster - two of my daughters work in retail I would never be rude to a sales assistant - I told the truth to him - explained assumed they would beabout a fiver - and that I had made a genuine mistake, but he said the policy had recently changed due to folks bringing food back at a later date ?0

£8.50 for two pies is rather expensive considering M&S have the 2 to dine deal PLUS a bottle of wine for only £10!

The store was heaving - food was all over place - not on right shelves etc. The pies just looked tasty - didnt think they would cost £8.50 - I am a regular food shopper at M&S most of their food is good value for money = these were overpriced for what they were. As I say too late now but think the excuse was lame - all food could be tampered with - if a wierdo had the inclination.0

It's probably more to do with cold stuff having to be stored at the right temperature. If you've taken them home and left them out the shop won't know (and you could lie if asked) but then they would be unfit for sale. It may seem mean as you'd only just bought them, but then where do you draw the line? Legally goods can be out of a fridge for half an hour, but as customers wander round the shop for a while before buying they couldn't time it as 30 mins from time on receipt. At Tesco you have 20 minutes to return chilled/frozen stuff from the time on your receipt so they can claim it can go back in fridge/freezer and be resold.If you find you are drinking too much give this number a call. 0845 769 75550
