One problem with taking emotion into account is that no two victims will ever have the same intensity of feelings nor will be affected in the same way. This would lead to an even greater inconsistency with sentencing than currently exists. I do question though whether 5 years is adequate if deliberate drunkenness is involved. Maybe that might be just about acceptable if someone strayed marginally over the limit, probably by accident, and the drink wasn't a factor in the crash but even then, I would be wanting some private time with the driver if you get my drift.
Yeah, victims 'having a voice' does seem like the real reason. I've not really had much dealings with court/court proceeding so I don't even know if they still use victim statements?Started PADdin' 13/04/09 paid £7486.66 - CC free 02/11/10

I wonder if part of this process is also to let the perpetrators see what effect such actions have on their victims.
I'm probably way off base, but I know if I had accidentally gone over the limit and it resulted in the loss of someone's life, then hearing how the victim/victim's families have been hurt/affected by my actions would be a far bigger punishment than jail time. Of course, this wouldn't be true of everyone.February wins: Theatre tickets0 -

I think that is what they are used for. But to be honest, in this case i dont think they made the least bit of difference to the offender.
He stood with his head looking down to the floor the whole time, shrugged when asked if he had anything to say after the my friends mothers statement was read.
To be honest though as much as i hate the guy, i feel sorry for his family - he has a wife and a young child who have to live with knowing what he did and not having him around.Biggest Loser Weight Loss: 13 / 20 lb0 -
