can I ask for those people who have returned earrings by post to m and s - and they have not been refunded - what has happened - have the earrings been returned to you or have marks still got them???

I have just had the dreaded 'can't give a refund' email, even though I have had a few refund emails today which have given refunds on earrings! haven't worked out which pair they are referring to yet. However, the email does say:
'To ensure that all of our customers are fully aware of our hygiene policy, we place warnings on the seals of the relevant products and also notices in certain areas of the store such as jewellery and bedding. Our website also shows this information and this reminder can be located in the payment and returns section.
I apologise if you did not see the information displayed on the website or in stores or were unaware that the seal displayed this warning. However, we do believe that we provide all the information necessary for our customers to make an informed decision about our products. Therefore, I am sorry to say that I cannot offer you a refund on this occasion and I have arranged for your items to be returned.'
I'm sure that there was no warning on the product when I received the jewellery? Has anyone else had this?
they said this on my email too. and i am pretty sure it wasnt written on any packaging. in fact some of the jewellery i received came in little food bags - not the usual cellophane bag.
in one of my replying emails i did ask what would happen to the earrings and they said they would be returning them to me
i dont mind giving some of thse to charity and i have probably only lost £5 -£7 but it is the principle that annoyed me0 -
Luckily I don't have anything to return because most of my orders were cacelled by M&S and I like the things I did get. I am going to complain about the postage charged on orders where they cancelled the bulk of it tho.
I complained about a Birthday order that took more than 14 days to arrive and they gave me a £5 credit on my account. It will only be of any use if I can spend it on a free postage day tho.
By the way... I received the DVD player and I'm chuffed to bits with it! This is my first ever glitch! I've already had my Dad round to look at it and my boyfriend is also quite impressed! Woo hoo for this thread and everyone who pointed out the fab bargains! :T0 -
If you look at any earrings on the website there is a note that says 'For hygiene reasons refunds will only be given in accordance to your legal rights'. I would suggest that returning items within 7 days due to Distance Selling rules is a legal right.
When you look at the refund policy on the back of the delivery note it does not exclude earrings under the Distance Selling rules. HTH0 -

Right who returned some jewellery to chesterfield store? I went to have a look at the clearance rail and there was a solitare ring and some of the horrible necklackes. All I did was think of you ladies!!!!Money, money, money, must be funny....in a rich mans world.

Although I have already received a refund, 3 pairs of earrings were returned to me today. I no longer have a returns slip for them, as I've already sent them back once. They are hideous, so I have no use for them (unless I go to a fancy dress party as Pat Butcher one day). But not sure I can face all the hassle of contacting M and S to arrange for them to be returned. If I'd known what was in the parcel I would have refused delivery.0
