Would it also make a difference that others who also ordered over the phone, presumably through exactly the same process, had their items delivered - or not? Do you just concentrate on your own scenario?

It would be a detail for the future. That would dilute your argument right now (but I fully understand the logic you are applying).

The concern at this stage is the reneging of a contract. The detail simply is that a contact has been established and as ': o )' rightly states, the misprice is no 'excuse' to not hold their side of the bargain. That, unfortunately for the vendor, is their problem. In the same way it would be your problem if you advertised a camera in the paper for £1.50 and someone came to view it and they said I offer you £1.50 and you said 'I accept your £1.50'.

Then when they leave you think, 'oh poop, this is a Nikon XZJ1112, worth £1500, not £1.50'. You have a bit of a problem there as the buyer has an enforceable contract with you, that should he pursue you with, would win. (That is a simplistic representation as there are other equitable issues to consider but it gets the point over).

The same applies here. Just write a letter explaining your contractual position and that they need to make good their part of the agreement now. The fact they have cancelled the order is not relevant. The contract cannot be extinguished because the vendor feels like it. The law will see it as it never ended. I am sure the vendor, when it is laid in front of them will not be foolhardy enough to ignore these simple principles.

Unless their legal team did their law degrees via not quite so good universities :)
  • Thanks again Cheshire Carper, I am going to write this weekend, when finished would you mind if I forward you a copy for your perusal before sending? From your advice it appears I should keep it simple & to the point and I know I have a tendency to deviate! And any constructive criticism would be appreciated.

Not a problem if not :-)

Whats the difference apart from the camera and a bigger screen.
The DSi also has network capability to connect to a WPA encrypted network, whereas the DS Lite can only connect using WEP encryption. This means that if you have DSs you can't connect to a home network with higher security, but you can if you get the DSi. (for instance I have a BT Home Hub 2.0 with WPA and I can't connect any of the DSs to the internet).
IMO this is the only reason to get a DSi.

Yes, be concise; what has happened to others, what you feel, what you think of the vendor are all irrelevant and will weaken your argument (not in reality but in impact and simplicity).

You argument is that of an enforcable contract and your argument is strong in your favour. This does not mean that vendor A will simply capitulate, as the process of acceptance by them can generate a floodgates scenario which will implicate them further. However, the law is on your side here (assuming you made a telephone order and received an order number/delivery number, not simply a text/online/phone reservation to collect in store).

You are welcome to PM me a letter and I will look at it, but, I am studying for a set of exams that begin in 3 weeks and my time on here is a little 15 min diversion every 2 hours (a treat if you will!). So, if I do not respond to you quickly, I am not ignoring you, I simply have my head in a book.

Send a letter. In law there is no difference but in the statement you are making, there is. Letters are stage one of a messy problem for vendors. They learn this :)
