But if you do understand the law, that, at this stage is completely unnecessary.
A letter to the vendor, explaining your position is the first stage. That will cost the effort and the postage. I would advise all that are disgruntled to write in explaining your position.....
The problem is that the approach the average lay person will adopt may be easily dismissed by the vendor. But for someone that understands the contractual position, then a different problem faces the vendor
I would advise at first instance writing in, in the best way you can.
Any contractual legal advice would cost you a little more than a DS at full price(and long may it stay that way
).
Thanks Cheshire_Carper, I am going to do a bit of work on it myself with the information you've given me. Thank you for all your help so far, very much appreciated. :T0 -
Anyone who has ordered by phone and wants to pursue it, shall we PM each other rather than making life so 'tedious' for some people on here? I am definitely going to be sending in a letter.0

I dont have a problem with that BUT.....I'm certain there will be people similarly affected and with similar thoughts who don't post but read. If this goes behind the scenes as it were, then it might not be helpful to others?
I'm more of the mind of....if people don't like it, they don't have to read it.Herman - MP for all!0 -
I think perhaps if the mods move it to gone but not forgotten then it will be not such a target.
I have sent a complaint through Argos website, they send you back a copy of your message and a ref number.
I hope they process my refund quickly thats the bit thats most annoying.0 -
Keep it public lol I am in the same boat as alot of you I imagine. Ordered by phone on the 30th Dec. Order went through no probs and was told del would be between 12-6 pm 31st Dec. Waited in nothing came. My order is still reading as despatched on the Argos site and I have had no call or any notification of a cancellation. Im !!!!ed off about it to say the least. Im gonna phone my local HDNL depot tomoz and see if I can get confirmation that the parcel is with them waiting to be returned. With this and a screen print of my despatched order how can Argos have a leg to stand on??0

Did you all get a reference number from Argos Direct? I've just been doing a little bit of homework and think that constitutes a Communication of Contract Acceptance from Argos.0

Yip.
For the first order anyway.
Had nothing at all for the second.Herman - MP for all!0 -
they took my money yesterday afternoon! If this was a misprice why did they take my money and not let me know that they were cancelling it
Once they take your money i thought this ment they have entered into a contract the seller and the buyer? and they are now obligated to supply you the goods.
Many websites T&C mention until the funds have been taken, they can back out. a last min safty net for them.0 -
I have a ref number for my order, they didn't give me a query ref number when they phoned to cancel the order but I have a ref numberfor my complaint through the website. The ref number came by email along with a copy of the message I sent.0

Will take a look at this over the next couple of days. There is some good info on Wikipedia, which I'll look at and double-check on other sites. I think we need to keep hold of those AD*********** numbers.0
