Yes, I said it is a DS for £99 - less the cashback and £30 off it'll be £62 (think I said £52, I was wrong there). Or you can get a DS for £119 and £12 cashback. Over £40 saving. Whats the difference apart from the camera and a bigger screen. The 'gotta haves' have gotta have I suppose. Get them a cheaper one and let them learn that sometimes they cannot have everything they want in life as it costs too much!!0 -

Wrong. I gave you all you needed to know to get your DSi but you clearly did not read it through your haze of rage at not getting your DSi....
You can make your claim for 'loss of bargain' here:

It will cost you £30, click 'I am a claimant' and fill the form in. When Argos defend their claim, as they will, you you have to pay another £100 to get the case heard. Of course you will get that back if you win. Which you think you will so you have nothing to lose, have you?

With all due respect, the theory one can read in Law text books and what happens in the real World can be different.
For example, (as far as I am aware) any English legal authority enabling recall of acceptance is a grey area. eg Argos advising the customer that the offer has not been accepted before the customer was aware of the despatch.
Just playing Devil's advocate here.
Hey, perhaps it's time for a brave MSEr to go for a test case and clarify the legal position.
The legal position is very established. To be honest, this situation is completely cut and dry. It is yr1 LL.B territory. Formation and enforceability of contract. Whilst I agree that the real world position can be different (we term that 'law in books' vs 'law in action'), a contract is a contract is a contract. It is enforceable.
It is very hard trying to explain it to someone that has not studied the law. You see things in a different way. If there is someone else on here that has read law, they will understand exactly the position. I suppose that is why the profession is viewed as it is.0 -

I suppose if you don't understand the law, then that is something for you to do (you would not have that legal argument btw, no one owes money here, this is a dispute over contract enforceability). But if you do understand the law, that, at this stage is completely unnecessary.
A letter to the vendor, explaining your position is the first stage. That will cost the effort and the postage. I would advise all that are disgruntled to write in explaining your position.....
The problem is that the approach the average lay person will adopt may be easily dismissed by the vendor. But for someone that understands the contractual position, then a different problem faces the vendor
I would advise at first instance writing in, in the best way you can.
Any contractual legal advice would cost you a little more than a DS at full price(and long may it stay that way
).
