It's weird. It has 'take action' then a drop down menu with options of pay now or contact seller.
If I click pay now it says:
These items are not available for payment. They may be already paid for, over 30 days old, or just currently unavailable.
If I click contact seller it has these options -

What can I do about an item that is damaged/defective/not as expected/missing parts?

Then it just clicks through to message the seller as usual
The email I received from eBay said this:
We opened an unpaid item case for Jean Paul Gaultier Le Male Eau de Toilette Spray 75ml, because the seller either hasn't recorded your payment or didn't receive it yet.Your payment must be received no later than Tuesday, 29 Dec, 2009 17:40:51 GMT, to avoid an unpaid item being recorded on your account (and possible restrictions).
If you've simply forgotten to pay, please pay now so that we can close this case and the seller can dispatch the item to you.
If you can't reach the seller or there's been a mistake, don't worry - you can appeal to remove the unpaid item after the case closes.

I'm wondering then if this new system is working on ebay 'fuzzy' (ie daft) logic then. Maybe you have to get the strike then appeal it and it is at that point that the seller gets a warning for having issued a strike for misuse of the system?

What should a seller do in these situations? Reason I ask is that I sent a small item off on the 4th December, have the proof of postage. Buyer emails me x mas eve to say it hasn't arrived. I am sending off the proof of postage today. Now do I refund, leaving me out of pocket? Or do I say to seller you claim off post office? I can't keep refunding as I make no money and loose out with p&p etc! Same time I have got to fight off a negative. In my advert it states no refunds and proof of postage obtained. I have refunded so many times before, sending stuff signed for makes no difference ether. Plus sometimes I wonder if the buyer has actually maybe got the item?0

It is the sellers responsibility to get the item to the buyer, you can say what you like about not being responsible but all you will do is get the buyer narked enough to leave a neg.
Why are you sending off proof of postage? You need that to make your own claim from RM, buyer is going to get a refund with or without your help via paypal anyway.
Refund, leave the buyer a positive apologising for book having gone astray and then after 15 working days recover your losses from RM using proof of postage.

Sounds like your seller is one can short of a six pack if you ask me.
I dont know what ebay will do about this type of misuse of their system but I can't see them being very happy about it.0 -

Firsty you will need to get your COP back as you can't claim without it. You cna get claim forms from any PO and can start a claim after 15 working days.
Secondly if you are losing more than say 1 in several hundred parcels then you need to find out why. Without being rude, do you hand write your addresses if so try printing them out instead in case your writing is causing problems. Check your packaging, I often have books take a few extra days to get to me purely because they are so badly wrapped, a bit of brown paper and a couple of tabs of sellotape and the whole parcel falls apart en route. I'll wait for the dispute to close and then I'll appeal it - don't really understand why the seller has done this as he sells as a business so it will have a negative effect on his account.0 -

I pack them pretty well, and I think my hand writing is legible, but I will be more aware of it now. I just dunno what's happening to them. Not selling anything for awhile now though.0
