have you got a date for the tribunal yet?

It's amazing how those with a can-do attitude and willingness to 'pitch in and work' get all the luck, isn't it?

Got an email through yesterday, the disciplinary has been scheduled for Tuesday at 10am. So i'll have some news then, not sure if they will give me their verdict then and there but given the fantastic help i've been given here and a certain MSE user who put in an angelic amount of work preparing statements for me, i'm sure they'll have to go away and consider it.

HR sent some of the (recently updated, with a tacked on alternative procedure for raising grievances whereby you go straight to HR in a "whistle blowing" instance - covers what the sales manager did) documents I requested, but it was suspiciously lacking the Alcohol and Drug misuse policy. I made sure to fire an email back saying that I need that too.

Would love a paid transfer to China, however I think that under the circumstances it would be highly unlikely, and in the future too with another employer -especially if I get fired.

I'll get back to you guys on Tuesday.

Just make sure your powder is dry, and all the I's are dotted, the T's crossed, and hopefully they may see what a waste of time, therefore also money and effort, has been spent at the behest of a p****d up manager on a mission. Good luck for Tuesday

if need be you'll need to see copies of the original HR policies and what dates the updates were made - this should all be documented and auditable of course;). makes my blood boil and just makes them look SO bad IMHO.

...and if HR policies are updated, wouldn't it normally be considered sound procedure for HR to make employees aware of the updates in a timely manner, so employees understand where the goal posts lie?

    yes, what a good thought!

i expect your employers have a quality/document management system, and i suspect there will be a demonstrable audit trail that cannot be 'tampered' with.

OP, is your place of work a branch as such of a national/international company or is it a sole site. i am thinking ahead (as previously experienced with my friend's employer) and wondering if the same HR team would handle any appeal (hopefully, NOT necessary), OR whether it would be another/senior team?

I hope they don't give you a decision on Tuesday after the hearing as they are meant to have a reasonable period of time to make the decision (usually 24 hours) after a disciplinary to make a decision.
Although if they call you back in after 5 minutes and sack you it will go in your favour for a tribunal as it will appear the decision was already made!!
