If your OH is over 25 it seems strange this clause is not included in his insurance, however I have a feeling some policies which allow you to drive any car 3rd party SPECIFICALLY EXCLUDE the car of a partner. Check very carefully!

Yes, but many insurers are wary of the cost and are excluding it from policies. I am excluded from driving other cars.

It's getting quite common for insurance companies to drop your 3rd party entitlement these days. I only found out after 2 years with Elephant, that they'd dropped the cover. Just as well I was never in an accident, since I was driving quite a few other vehicles over that time. Now I specifically ask if it's included in any cover. Have been with Co-Op for about 3 years now, and they have been great.

Surely you are named drivers on each others policy as it is normally at no cost and often cheaper than a single driver policy

Well get him to produce the required documents and take it on the chin for the no insurance.

If I were you I wouldn't got in case they decide to report you both.

Let's hope PC Plod is in a good mood.

In a bad mood they'll need to decide whether to do the driver for twoc (probably difficult if the OP was in the car at the time) or to do the owner for allowing the car to be driven on a public highway without valid insurance.

Depends which story you prefer. As they say, they'll do you one way or the other ...

It would have cost about £200 more to insure me on his car and just did't think to add him to my insurance because my mum and brother are already on it.

Does he just take his certificate or both?

He didn't asked for out details when we were pulled, so wouldn't know who the passengers were.

I totally accept we are in the wrong for this, just want to know the best way to go about it!

How on earth could twoc ever be commited in these circumstances? More than probably difficult to prove, more like not ever going to be proven!

If they tried to prosecute under use cause permit rules then the op has already stated a recognised defense; she was under the impression the driver was insured. She's under no obligation to see a certificate.
  • Before discounting being insured READ THE POLICY DOCUMENTS. All of them. That's the long boring bits and not just the certificate.
  • OP i wouldnt worry about the cause to permit it down to police discretion weather to charge you or not and it would be unlikely in these curcomstances as you didnt permit to drive knowing he wasnt covered as you thought he was covered and even IF the police wanted to talk to you about the situation i doubt you'd be charged more of a telling off "caution". OH would need to telephone the insurance to find out weather he is covered. if not covered he will be reported to the CPS (crown prosecution service) he will then receive a summons to court, he may then get 3-6 points and a fine (fines vary) or a short ban and a fine. i'm not sure weather theres a time frame on weather they have to get it into court by though.
