  • help, have just come across this forum today, compensation?? all i have received so far are two letters from plum products, one in december 2009 promising replacement parts, the second in february this year, (after i emailed them to ask where these parts were) talking about a recall, and that i would be hearing from argos soon, have heard nothing so far, we bought our tacoma in march 2007, less than 3 years old, all wooden parts guaranteed for 12 years, it cannot be right to be offered such a paltry sum, interesting though, the email i was sent in reply to my query on the replacement parts(promised by end of january) simply said that there was a delay and that i would receive the parts by the end of february, no mention of a recall.
  • Only found this site today - thought we were the only ones annoyed at our £133.33 refund (bought Tacoma - aug 2005 for £399.99). Found the Adventure Playsets owners manual and it clearly states all wooden components are warranted against rot for 12 years - surely the playset should be replaced. Ours appears okay and it's driving my daughters mad not being able to use it!

    I bought the Tacoma II play centre in June 2007 and I received the letter from Plum Products in December last year and in Febuary this year.
    Friday I received the letter from HRG (Argos/Homebase) and I rang the free phone number stated. The guy on the other end of the phone didn't seem to know what the deal was except that a manager will ring me to discuss the partial refund.

    :mad: Not happy with this at all :mad:

    I think Argos shuld stump up a replacement with all the features that the Tacoma II had, or provide a full refund of the purchase price.

    I think a letter to BBC Watchdog could be the next step!

    We all need to work together on this one.

    Sadly, what most of you think Argos "should" do and what they are legally obliged to do is somewhat different in this case. However, the more pressure you can put on them the better the outcome may be, even if its just an attempt to stop any bad publicity coming their way.

    Can anyone tell us what exactly argos are legally obliged to do?

    Perhaps we should be chasing Plum Products (the importers) or Adventure Playsets (the manufacturers, who gave us a 12 year warranty on all the wood components of the play set.)

    I would write to the manufacturer, who gave you the warranty, and give them 28 days to rectify the situation and replace the unit like for like as the unit is no longer safe (as per copy of letter attached).

    Tell them you would like it replaced under the terms of the warranty. Tell them that failure to replace the unit will result in you claiming for an identical replacement unit via the small claims court and they could be liable for further costs. Certainly not worth seeing a solicitor, you can do this yourself for free.

    Send the letter recorded delivery so you know it has arrived.

    I would chase the manufacturer who gave you the warranty. Argos only have a duty to refund you less wear and tear which is what they are doing. However, once you no longer have it you will have no warranty (obviously) so I would be going to them first.

    After 28 days go to this website and fill in your claim and it costs £30 so worth a try: https://www.moneyclaim.gov.uk/csmco2/index.jsp When you make your claim find a unit you want to replace it with (it will have to be identical and preferably from the same manufacurer) and put the RRP as the amount you are claiming (plus money for installation if you have it installed previously and paid for this).

    If you paid with your credit card you can claim from them too but start with moneyclaim.
  • I have checked out the plum website and the nearest product-with monkey bars is £899, it seems they have stopped doing cheaper versions with monkey bars.
    My worry is that even if we accepted the Meerkat, with it not being available till May, call me cynical, but if they take our play centers away, what guarantee is there that they will deliver the new one in May, maybe they will say they no longer make them and give us no option but to take the money, I will NOT be allowing them to take my Tacoma until it is resolved.

    Which is why you should send the letter giving them 28 days to rectify the situation. It'll take approx 2 months to get through small claims court and will make the manufacturer realise you are not going to take a cheaper version.

    Seriously, bypass Argos and Plum and go to the company you have the warranty with. Makes me wonder why Argos are so keen to get them collected. Should they have been sold at all?

    Who did the letter come from? Can anyone scan one in for everyone here to have a look?

    I nearly bought the plum one but my kids were too little for the monkey bars.... lucky escape!!

    To add: If you send it back then it would be deemed that you have accepted a settlement. DO NOT SEND IT BACK UNTIL YOU HAVE AN AGREEMENT YOU ARE HAPPY WITH, IN WRITING!!

    Adventure Playsets is an American company based in Texas! Will that affect small claims court?

    Looking at the warranty, it dosen't cover cost of air freight or cost of any freight after 30 days from purchase, so even if Adventure playsets said they would replace the defective parts then we would have to pay the shipping.

    Looking in the instruction booklet there is no mention of a CE mark or BSI kite mark. So maybe they shouldn't have been sold in this country?
    I thought the safety standards in this country were very strict about this kind of thing especially with childrens toys. It's not as if we bought them off a dodgy trader at a Sunday market we got them from a major high street retailer!
