It's a toughie, as you haven't yet paid.
You ought to pay really otherwise you're risking a strike. But he's playing hard ball - so it could be a monumental waste of your time.

With all his feedback, HE should really know better.

I'd be tempted to pay, and follow up with an email saying 'Hi, I have paid you as I am obliged to do as I won your auction, but I would like to request that you despatch my item within 7 days in accordance with ebay's requirements. I'm sure you appreciate that BACS payment offers a buyer even less protection than paypal offers a seller, so I'm unable to use this method. Thank you.'

    The whole thing's a mess really :(
    My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

seems odd to me does he actually have the item or is he buying it with the funds ?
As far as I can gather, he has the item in his possession.

what if this was meant as a Xmas gift for someone? Yes it would probably be delievered within time before Xmas, but i wouldn't like to take the chance when i had won th eitem at the beginning of December!!!

I'd be going with this suggestion:
I think I would tell him that I had no confidence in him as a seller and would therefore like a refund ASAP so I can buy elswehere from a trusted site. If he refuses slam in a claim on day 7.

If he agrees to a refund refuse a mutual to cancel the transaction and make sure you leave appropriate feedback.

Call his bluff and refuse to pay, as he did not state the terms under which he would accept Paypal in his auction. If you get a NPB then so be it. You can leave him a neg for the lack of transparency in his auction terms.

It's a Christmas present for me. Relatives are putting money into the pot for it, alongside money from the sale of my old one. I obviously want it as soon as possible. I haven't yet paid, but this whole thing has left a bad taste in my mouth. I was dancing around the room when I won it, now I just feel sad!

I don't want to refuse to pay, as that makes me an NPB, but at the same time, I'm not prepared to wait for funds to clear for him to send it. I want him to comply with Paypal and send me my item immediately.

Could you not arrange to meet up/collect/him deliver and pay him cash? Obviously with someone else with you.

I could do, but the earliest I could collect is next weekend. I bid because I could pay by Paypal and get it sent to me though, much easier.

    Is this response appropriate?

    Hi,

I'm not willing to pay by BACS as this offers me no protection. I checked on the auction paypal payment section and it says; "A payment is considered "cleared" after the money from the buyer has been deposited into the seller’s account. If the buyer pays by PayPal, the payment may clear immediately. However if the buyer pays by cheque or money order, it may take several days." By sellers account it means your Paypal account. I will pay immediately after assurance you will be complying with Paypal's requirements for you to send within 7 days.

    Regards,

I doubt that you will get it much quicker than the end of next week (Xmas Post) anyway, unless it is next day special delivery, so collection may be a better bet.
