Did SKY say that it was free gift which was only available if you took out a subscription ? I think not. I imagine the advert went along the lines of "As well as the channels that are available on subscription, there are hundreds of free channels which can be received on the SKY box" That is not the same thing.

Show me that in writing. Did they say that you could only receive this channel if you took out a subscription? By it's very nature it was a free-to-air channel that did not need any sort of subscription.
