Finally spoke to a manager at the solicitors and we started to get somewhere, well may be!
It appears that the CSA have not told them all of the story and he was a little miffed that they have an agreement in place that they brok and have paid me compensaition for! He was also interested to find out about the Ministerial interest in this case and again checked with the ASC on this point, it appears that the case has been put on hold untill the Minister makes a decision!
I also went throughthe law and the figures with him and he agreed with my assesment that under the law and if the house is sold then they will only be able to get at best £1200 well short of what they are after. He has taken this back to the CSA as well to see what they have to say about it. The feeling that I got is that he will push them to go back and stick with the agreement, but will have to wait till tommorrow to find out!

Have sent up the doc's they request these include letters from 2 firms of solicitors that dealt with the sale and buying of the relevent properties, as well as the ICE report that got me paid compensation for the breach of the agreement that was in place and that I am still liveing by!
Just have to wait and see, what teh CSA come up with as the solicitor want to know just what undertakings were requested by The Court, and unless the CSA have got them from the Court then shame I feel that the Solicitor will say thanks but no thanks, I hope. The figures that we have gone through were without the costs of selling the house that would have to be paid as well so we are in to negitive equity as far as they are concerned!0 -
You will never guess what and will be supprised to hear that the solicitor was on the phone and has told me that the information that they had asked for and has been sent had not arrived according to them! The post office have a different point of view as they have a signiture from them as haveing recieved it, oups!
The people that are dealing with the case admit that they are not solicitors and have no knowledge of the parts of the law that I talk about, and we are now on the 3 person in the office that has picked up the case! It seems that they dont talk to each other either!
Just when you think it cant get any worse the system proves you wrong! The old saying must be true, never underestimate an idiot!
As a result of this my partner has ended our engagment and is takeing me to court to get her money, by the time this is over the vultures will not be able to have anything as there will be nothing left, now or ever! I suppose it must make sence really, destroy everthing and get nothing or keep to the agreement and get what they want. They will as a result of their own actions get nothing as they will have destroyed everthing!

I am really sorry to hear that Blob - maybe she will calm down when she has had a bit of time to think about it? Its an emotive time of year and when everyone is under a lot of stress sometimes things blow up and we all say things we regret.
Do you have any legal representation? I know that NACSA do representation at a very reasonable cost and it may be worth putting out a little bit of money to save yourself a lot in the long run if that makes sense? Surely though if they have told you they are solicitors that is misrepresentation if they are not really and that should go back to the CSA or am I missing the point somewhere?
Just as well you sent everything recorded, at least that way you can show it has been recieved and so if it DOES get to court you can ask for an adjournment on the basis that they have had information which they have failed to take into account.

Blob, did the info get sent to the solicitors direct or the CSA? If the CSA then it doesn't mean that it hasn't arrived at all - but not necessarily with the correct department, as the post gets opened somewhere entirely different to its final destination.0

It was sent to the Solicitors! Though that word seems to mean very little to them, it would appear that at best they are Legal Exec's.
As for the CSA they are not there forthe children end of as the course of action that they are on will mean that the kids get nothing in the fullness of time or even now, as it has been expleined by myself, my MP and 2 Judges that if they make me homeless, then they will be putting me out of a job as well! Result, they will not get the arrears ever and then will not get any further money as there will be none! Quite a result really!0 -
As you have said, if there is not enough equity in the property, they won't go to enforce a sale.0

They have gone to a level 3 letter! They believe that there is so it really matters not what people say, they will go for the sale and fail to get anything at all, but will distroy yet another family unit! If they then as a result get me sent to prision as they are getting nothing, great, as at least I will be feed and housed, which I wont be other wise!0
