Any idears

Hi

Anyone got any idears on how to tell an NRPP that she is going to loose her home and the CSA take her money to pay a debt that they have admitted responsibility for.

They have admitted lieing in Court in the figures that they used, ICE has found against them twice and they paid out, the Ombudsman has found against them they made a deal and have now broken it! They have failed to give undertakings to a Court when asked and have been sanctioned by the Courts.

They have broken directives from Ministers and now my MP has asked why and wants Ministerial intervention. With all this they are now going to apply to make us homeless and they still wont get the money that they want!

All they have to do is go with teh agreement and they will get al thte money they want and we will keep our home that my partner has paid some £75k on. She is in tears and I dont know what to say, anyone got an idear.

    Sorry to hear that Blob .We lost £7k to the paracites .Is there nothing that a lawyer or NACSA can do .Get the house out of your name and into your Mrs before they take an order on it .

    Spent half an hour talking to the Union Legal people they dont hold out much hope as they say they are not bound by the law like the rest of us, and really there is not a lot the Courts can do about them! Said it all really!

    It's no good transferring the house now, we looked into this and it would have had to be done prior to any action. This is a terrible situation, it amazes me that common sense does not prevail where the CSA are involved, like you said if only they stuck to agreement they would get their money, where's the sense in forcing a sale, making a family homeless, not to gain profit, and then presumably have to chase the homeless NRP for driving licence/committal as sale of property did not generate enough revenue!!!!!! It's despicable.

    If you transfer the house now then you are depriving yourself intentionally of the asset and they can still enforce the order.

    Can they not put a charging order on the house whilst taking a payment on a monthly basis? Surely that would cover all bases? I dont know how much you owe to them but it sounds a considerable sum

    Have you put in an appeal to stay proceedings whilst you try to work it out? That is the only thing I can suggest because half of the equity in the house will be allocated to your partner as her name is on the deeds. If you can prove that she has put in more than that then she may be awarded more than that, but the house will be sold to pay off your debt not hers.

    Have read back through your previosu posts as well Blob - I think you need to go back to your OR and ask why these arrears were not cleared as part of your order. They should have been allocated as a priority to be paid BEFORE the other debts rather than any money being taken into the order. Sounds like you may have a case there too.

    Can't help, just desperately sorry for your situation! It shouldn't happen. Some people on here swear by NACSA - have you given them a go? If you have and that didn't work it might require hiring some superhero suits and a chilly night out on a roof somewhere. I'm sure some you'd get support here, whatever you decide to do.

    Thanks for this support it helps.

    I have today heard from my MP that he has demanded Ministerial Intervention in this case as there are some details that have not been posted here, but most have I wont labour the point. The only problem is that they have disreguarded this kind of letter and intervention in the past. As the press are now interested and there is an election coming, and last night one of the parties phoned me and asked if I would run for election on their behalf, who knows this time it may get through!??

    Suffice to say there have been more tears this evening. What I would give to have 2 mins alone with this person, I promise he would never reduce another woman to tears again!!! As he would remember the experiance for the rest of his life.

    I have heard of NACSA, google them. I believe that for general information they are very good. It’s cheap to join as well!
    When you join they can be a mine of information.
    However, when you ring them you have to leave a message and then they call you back. They tend not to answer the phone when you ring them.

    Others on here mention a solicitor called Stephen Lawson who is supposed to be very good when it comes to all matters CSA. I have no personal knowledge of him at all.Don't know what he charges but I have read on these forums that he will give you an estimate of his charges at the beginning.
    Probably not cheap

    There is another firm called Durham Legal Services and I have only heard mixed reviews about them. I have no personal knowledge of them at all.

    There is another firm called Child Support Solutions who are in
    Birmingham.
    They specialise in all matters CSA related and charge a monthly fee.

    In some cases they take over all contact with the CSA and basically fight your corner for you.
    I do have personal knowledge of this company. I am not affiliated to this company.
    Not cheap, but very effective in my case!

    The above are the main people/companies/solicitors who specialise in dealing with the CSA. Google them all and see what you think

    Just my opinion, but NACSA and SL worth a go, don't bother with DLS in our experience they made a huge error when advising us, that cost us a LO

    From what I recall, there are still some arrears even after all the corrections. I had a feeling you had an arrangement to pay these arrears and therefore they could only apply to court for sale if you failed to keep up to the arrangement, although I wonder if they can apply if there they can prove you could afford to pay more.

    If it appears the sale will be forced and you cannot stop it, I personally would seriously look at ways to raise the money to stop a sale.
