Hi LS
There are no options open we have no money, we cant raise any money in the present climet, the result of the sale is that they may get £2,500 max and this is no where near what they want. The follow on will be that I will loose my job as well. Lets think about how that will leave the situation, the tax payer will have to house me, and keep me for the rest of my life, the cost to the Gov ££££. They will have destroyed a new family unit, and not for the first time. Long tearm, they will have deprived the PWC of say with the maintaince that they will not get and the arrears some £35,000. They will have taken the chance of the children ever getting any money from either of us when we die as their mother has spent every penny she has ever had and will not leave them a penny.
Can we say that they have acted in the best intrest of the children, I think not!0 -
Blob you have £35,000 in arrears?*SIGH*

Get the house out of your name and into your Mrs before they take an order on it .

To transfer the property to someone elses name, complete a Form ID1, AP1 and TR1 and take them to your local land registry office. The transfer is exempt from stamp duty.

When they pass the case to the solicitors to decide whether to go for an order for sale, they consider the equity in the property - if there is not enough equity in your share to repay the debt then they won't do it - honest they won't as it isn't worth the hassle and doesn't solve the problem.0

You have not tried to talk to this guy. He failed to call back when he had arranged to, I doubt he is a solicitor as his grasp of the law is shall we say a little vage! I doubt he is even a Legal Ex, it is one of the questions I have left on their answer phone as they never answer thet phone either! If it comes to pass that he is either then the govening body of the groupe he is with will be gewtting a call, he wont be the first lawer that has gone after me and had to rethink his carear path as a result!
You are though absoulitly correct the path they are on at this time will solve nothing at all, and cost teh Gov a fortune as well as the Tax payer, something that if they go through with their plan I wont be, well income tax anyway!0 -
On a lighter note in this time of troubles, her indoors has just taken the washing out of the machine and found that she put my new work Sweat Shirt' in with some of her bits, she now has blue niks, oups!
To the people that check these things sorry for going off topic, but I do need to laugh and I bet it has happened in your house as well!0 -

Finally spoke to a manager at the solicitors and we started to get somewhere, well may be!
It appears that the CSA have not told them all of the story and he was a little miffed that they have an agreement in place that they brok and have paid me compensaition for! He was also interested to find out about the Ministerial interest in this case and again checked with the ASC on this point, it appears that the case has been put on hold untill the Minister makes a decision!
I also went throughthe law and the figures with him and he agreed with my assesment that under the law and if the house is sold then they will only be able to get at best £1200 well short of what they are after. He has taken this back to the CSA as well to see what they have to say about it. The feeling that I got is that he will push them to go back and stick with the agreement, but will have to wait till tommorrow to find out!0 -
Keep us posted Blob.*SIGH*
