    Thanks everyone, I am trying to relax but finding nigh on impossible at the moment!

    Hubby has got a BR hearing Thursday!!! Can I just take this opportunity to say Michael at Salford County Court is A DIAMOND!

    I just hope this is enough for Northern Shock, but we will see.....


    In the meantime, does DHs SOA look OK?

    Havent included the blimmin mortgage as we all know the situ there, and havent totted up debts yet-but income and outgoings are all done-are these OK?


    Also, as mentioned in OP, hubby hasnt paid tax-how does he put this on his form?

    Hi Kerry, a little bump for you becaus i'm not very good at SOA's - just wondering why £22 TV licence tho, i'm sure it was £12.. just quibbling like an OR might because there's no way you would get an IPA as far as I can see.

    About the tax, I was a self employed childminder and worked for 6 months before it all folded. I owed the tax £65 which I didn't have as I was under the impression low earners didn't have to pay. I called OR and she added it to the creditors list. I guess just put the details on there as best you can, the OR will know what it's all about. As you'll know the SOA is not really for the BR hearing - it's for the OR to work from and your OH will talk to him anyway.

    I feel like i'm teaching my granny to suck eggs here.

    Anyway.. bump!

    Hi Kerry, cant see any problems with the SOA, all within acceptable limits from what i can see.

    On the OH tax situation, has he got any records of his income over the period, If he has he could do a quick calculation Average takings less average business outgoings. then take 15% over the 6 years as tax. This is very rough but might give the OR an idea of what the likely bill could be. Otherwise he could ring the HMRC and ask them.

  • Hi kerrypn can I suggest you take a step back and put things in perspective. 1. if the sale went through there would be a shortfall, so if you voluntary repos or of NR repos there will just be a bigger shortfall which will be swept up in the bankruptcy.The only remaining problem appears to be the solicitors fees. Are you sure they cannot be included? When were they incurred? Was the solicitor working on the sale when you went bankrupt? Speak to your trustee. If they definitely cannot be included then C.A.B. can help to negotiate an affordable offer even if it's a pound a month. You've got enough to think about without worrying any more. P.S. don't forget to claim your tax credits after baby is born. Make the most of your fresh start. If NR are being unreasonable, complain to F.O.S

    Mich, the TV licence is so high cos its the first year for me-you have to pay £5.50 per week-I was surprised they make you pay over 6 months not 12 too :(

    Debtinfo, he really has no clue whatsoever, if I am a disaster with money he is the Hiroshima of personal finances, he can't even "guesstimate". He has never even registered to pay tax :( Do I put HM Customs as creditor? Leave tax as unknown? He's gonna get a BRO for this isn't he?

    I definitely instructed solicitor POST BR but is was always agreed to come from proceeds of sale-The only reason I agreed to it. Solicitor knew from the outset about BR-because he wanted 50 quid up front and I clearly havent got 50 quid so I explained and he waived it til completion.

  • If your OH has not gone BR yet can you not put the solicitors bill on his list of creditors?

    Hi kerry, on the solicitor thing, you have done nothing wrong as you informed him of the bankruptcy.

    Sorry i assumed you knew about the tax consequenses. Does he work for a taxi firm, will they have records. He really needs to come up with some information such as how often he worked or roughly on a day or night how much he earned as these questions will be asked when he goes bankrupt. for nstance if he can show that he would not have paid any tax anyway due to low earnings the OR probably wont do anything as no one has lost out

    How about bank statements did he pay it in
