Oh and BY THE WAY this thread was started in 2009 and the last post in 2014, so it seems (unless this was an extra lengthy discussion about ONE ticket) that I am NOT the FIRST to HIJACK this old one. THANKS

The law also changed back in 2012 and the situation is very different now, so I hope you can see how it is seriously unhelpful to have old/outdated advice bumped back to the top of the board as these days it could land someone else in more trouble.

Well it looks to me like Debt Recovery Plus and or Excel Parking Services are operating some kind of scam. I had a letter from Debt Recovery Plus Ltd who say that they are acting on behalf of "The Creditor" Excel Parking Services.

Debt Recovery Plus claim that I failed to display a parking ticket whilst parked at The Peel Centre in Stockport and are demanding payment of £160.00. Debt Recovery Plus makes no mention of any times nor does it provide any evidence or copies of the PCN or any documentation whatsoever from Excel Parking Services.

Luckily, I still have the parking the parking ticket. So, why would a motorist go to the trouble of finding a ticket station, pay for the ticket and then fail to display it in the car!

Additionally, I was attending a business meeting which, as always, I recorded from start to end, including getting back into my car and driving away. My recording is time stamped.

I know that a parking ticket can sometimes get blown off the dashboard when closing the door but this was not the case here. I am always conscious of that happening.

So, why then, when I have payed for, and properly displayed a valid ticket for the valid times, and parked within the permitted times does Excel Parking Services claim that I did not display my ticket?
Is Excel Parking Services in association with Debt Recovery Plus Ltd acting in a way that they know, or should know amounts to fraud under Section 2 of the Fraud Act 2006

on trying to pay none of their machines were working to cut
the story short I have received a £100 parking penalty in the post
I sent them back a appeal letter stating I tried every machine
but not only did they not consider my appeal they didn't even
bother to read it properly they say I should have tried the OTHER
MACHINES not just one ? and I still have to pay How do I stand
with the law if I now just ignore them

you have 6 years to ignore them and the debt collectors

EXCEL (or the landowner) have 6 years to bring a small claim against you (an MCOL)

if the latter happens, a judge decides if there is anything to pay, or not

    same advice as usual

    1) its not a fine so that isnt true, its a speculative invoice (an invoice)

    2) you appeal as per the NEWBIES sticky thread

    3) if they reject your appeal , you should be able to appeal to a kangaroo court called the IAS (where you will likely fail)

    4) you then ignore all except court papers for 6 years (same as in this thread)

if you need further help, please start your own thread using the NEW THREAD button

this thread is so old it doesnt even take account of the changes made in 2012

read anything that is 2015 only, nothing from previous years
  • Has any one had any recent information on this? Has anyone not paid they're fine and been ok, as these posts are from a few years back
  • What changes were made in 2012?
