Good luck Spud, I love this environment where people help each other so willingly with anything.
Will be thinking of you and hope to hear some good news soon

Thanks McBirnie,
Our gross misconduct reasons are the usual, theft of company property, physical assault etc, yet I wasn't accused of any of those.
I haven't been asked to submit a written report, and dont have an appeals officer that I know of.
Can't say I'm looking forward to it at all.Is it better to aim for the stars and hit a tree or aim for a tree and land in its branches :think:Loves being a Wonderbra friend :kisses3:

Have you got someone to attend with you Spud?
I'm not sure now an appeal for gross misconduct works, I appealed unfair dismissal and it had to be completed before my end date.

Did you write a formal appeal letter outlining what your grounds for it are? only by the message above it doesn't sound like you have a lot of the information you need?
I went to mine with someone who continued to work there, that's what makes people good friends! Mine was advised they weren't allowed to talk but could take notes etc They then went through my letter which had outlined my reasons and they fed back their findings against each point. Then their final conclusions and what they thought would be a suitable outcome of it. I just said thank you and I would let them know then fed it all back to my lawyer! He then advised and dealt with them direct. I was cross more then fearful by then.
Have you seen a lawyer? What have they thought of the situation?

A lawyer, no I haven't.
I just wrote a short, to the point letter stating that I wished to appeal the decision as I didn't feel it had been fairly reached.
I now have to go in front of a panel of senior managers who will hear the appeal afresh.
OMG do I need a lawyer :eek:Is it better to aim for the stars and hit a tree or aim for a tree and land in its branches :think:Loves being a Wonderbra friend :kisses3:

No oyu don't, you just need to state why it was unfair.
Start with the points raised above and go from there.0 -
You should be able to get a free 30 minute session with a lawyer, and yes I'd definitely recommend you see one. Get one that specialises in employment law. They will advise you greatly on the case. Mine advise me what to write in my appeal letter. If you go and see one have all the detail noted down so you don't waste time trying to remember what happend when and how.

But hasn't the letter already been written?
Is this the company appeals process or a formal tribunal?0 -
