T-Mobile selling customer details: Enough grounds to end your contract?

    i personally am with T-Mobile & was contacted out of the blue last week by 3 advising me that my contract was coming to an end soon - they called me on my T-Mobile number and had all of my information. i never gave T-Mobile permission to pass on my details to third party companies so by doing so IMO they have breached the contract i have with them

    Ditto - the company that phoned me actually led me to believe that they were t mobile. They knew (or at least guessed) a lot of details about my account - and were so convincing that I ended up giving them my account password, after they sent me a text message that looked like it came from the t mobile retentions department.

    The penny eventually dropped and I contacted t mobile who confirmed that it was an approach by a private company. I almosty t ended up with a very expensive phone I didn't want.

    ""Thanks for your email xxxxxxxxxxxx letting us know that you'd like to end the contract for your pay monthly phone. We'll be sorry to see you go.

    In order for us to terminate your contract you have to call us so we can check your personal details and make sure the request is from the account holder.

    The need to call us to end your contract is included in your terms and conditions and your 30 days' notice can only begin once we've received your call and verified you as the account holder. Until then your contract with us will stay in place and you'll still be charged as normal, so please call us as soon as you can.

    Simply dial 150 from your T-Mobile phone and choose option 5, then 3 and our customer support team will make things as smooth as possible. They may even be able to provide a deal that'll convince you to stay with us, so be sure to ask. We're available Monday to Friday 8.30am to 10pm, Saturday and Sunday 8.30am to 8pm.

    If you're unable to call from your T-Mobile phone then call 08454 12 5000 from a landline (calls are charged at local rates if you're a BT customer, but if you're with another provider it may cost a bit more. Please check with your provider). We're open bank holidays 8.30am - 10pm excluding Christmas and New Year.

    Not strictly true. If you have valid grounds for needing to cancel due to their error in any way then you still possibly can.

    Fair enough, in this case it was only upgrade dates and some details ie name, address, phone number which seem to have been leaked. However, the very fact that ANY info can be leaked is serious: we were lucky in this case, but it could easily have been any other personal details ie bank details. I think it's perfectly reasonably to expect to be able to walk away from a contract when the other party is not actually showing you the reasonable care they should.
    I accept no liability if you chose to rely on my advice.
  • Good luck with that secretmsg, you'll have to let us know how you get on. I suppose that T-Mobile will have some expensive lawyers employed to help them get away with it.

    Im with T-mobile and received a couple of phone calls from Indian call centres plus I had a few missed calls from unknown numbers when one of the phones on my account was up for renewel last month, any excuse to leave T-Mobile.

    At this stage, and until sufficient investigation has been done, you are not in a position to state whether or not they have taken reasonable care. The guardian reported at http://www.guardian.co.uk/uk/2009/nov/17/t-mobile-phone-data-privacy the following
    "Will there be any compensation for the breach of data protection at T-Mobile?It looks very unlikely."


    Time will tell, but all the news reports are framed around the ICO targetting the people who have bought the lists and not T-Mobile who are being portrayed as the injured party.

    If T-Mobile wouldn't let you cancel because of the roaming increase (irrespective of whether legal or not...) I doubt they'd do it for this.

    You need to understand that T-Mobile are the ones respunsible for your data just as a bank would be if one of their employees left your details out in the street.

    It doesn't matter who or how it is done, it is up to T-Mobile to make sure it doesn't happen
