Spped Camera

Not sure where to post this so apologies if this is the wrong place.
I was driving my 3 small children last week. My 2 year old was given a sweet by my 4 year old. He started to choke on it so I sped up to a lay-by which I knew of ahead. This took me through a camera. I was doing about 7 miles over the limit and was subsequently flashed. I telephoned the local authority and police as soon as I got home but all they said was to see if I get a fine.
Any advice if there is anything I can do before I get the ticket? Also my car is registered in both my and my husband's name. Who will they send the ticket to and how do they know who was driving?

  • I believe they will send any report of an infringement to the registered owner of the car. Bear in mind that there is a possibility that there is no film in the camera as other drivers may have used it up and in some areas it does not seem to be changed too often........perhaps that is what they were trying to say to you, without any guarantee of course.

    The registered owner of the car might be obliged to say who was driving at the time (if it gets that far).

    If you contest it you will likely pay legal fees and get slapped harder if you lose the case so you should weigh that up against your feeling that you were doing the right thing by speeding to the layby

    It is very difficult to get off paying tickets (and points on your license) without something you can prove. Still, wait till you get the ticket and then read the info about contesting it. Another thing to be wary of is if the price goes up if you don't pay it back within a certain date.
    Someone I know managed to get out of paying one once (going through a red light) by claiming there was a fire engine behind them and they had to roll forward to let it through (within the law).
    He was telling absolute porkies, but when writing to the fire department (figured it was worth a go as he thought he heard a siren afew mins earlier), got a letter stating that there was indeed a fire engine in the area (along that route) at that time, and using that as evidence, got out of the ticket.

    I was passenger in a car , we turned right on the main road from a side road, reached third gear and came across a policeman with a hand held camera, about a month later he received a ticket saying he was doing 40 plus in a 30 mile zone, running alongside the picture is a white fence and brickwall behind that, i just wonder how the speed was registered so high as was under 30 miles after just turning right and on looking on various sites saw a few people claiming about the "slip effect where the radar signal bounces off fences and wall", he therefor has written into the police to ask about the date the camera was last tested etc.
    the reply back gives the date as last year and that is in good working order?
    he has elected to not pay the fine and let things proceed, back came a letter to say he had not identified himself as driver of the car? adding another charge.
    A few letters were sent back and forth each on headed note paper the latest is the charge of speeding and driver identification.this after a period of some 4 months when no communication was received.
    the person who posted about not fighting the ticket is most likely right how can you argue your case?

    If you can put up with the hassle, I'd take it to court.

    Alex bleeding Ferguson got off with driving up the hrd shoulder because he needed the loo. Saving your child's life must be a better reason.

    Read through the forums and ask for advice, giving as much detail as possible.

    The basics are, there is nothing you can do until you receive a notice of intended prosecution which should be with you within 14 days if the camera was working.

    I've had about 6 of these, the problem with NIP's is that we also have a law that protects us from incriminating ourselves, this was not so much of a problem until the Euro human rights acts, also if you do incrimintae yourself by signing the NIP and stateing who the driver is there is a grey area as to if the info is permissible in court as its basically signing a statement, and to sign a statement under UK law you must first recieve a caution.

    The way I got out of all 6 (over the last 5 years) was to simply ignore the NIP, they usually sent a cover letter a few weeks later asking why I had not returned the form but after that I have never heard a thing again, plus they are sent by standard mail not registered mail so how they could even show I got the letter baffles me.

    The system seems to rely on people playing the game by their rules and being good little citizens, filling out the forms, paying the £60 and taking the 3 points, I think it boils down to your personality in how you decide to act.

    Plead guilty, essentially you were speeding.
    However, in mitigating circumstances tell them what happened.
    I got off a parking ticket taking son with abcess to dentist.

    If you accept the Fixed Penalty there's no plea because it doesn't go to court. The scammers will take your £60 and award you 3 points. Mitigation hardly ever works in a Mags court, there partners in the scameraship :rolleyes:

    Alex Ferguson had Nick Freeman (Mr Loophole) as his lawyer and he aint cheap ;)

    I don't want to get into an argument and I know I'm moving away from the question that the OP asked, but people who say "I got out of " their speeding fines really gets me going.

    YOU broke the law, so why shouldn't YOU pay up? I personally have been caught for speeding twice. I was breaking the law, so I paid up. The last time I was caught was in May 2003, so in 10 months my licence will be clear of points.

    Since then, I have NEVER intentionally sped. Of course, there are occasions where I find myself going a couple of miles over the speed limit unintentionally but I always ease off. Even on the motorway I refuse to go above 70 miles an hour.

    I can only imagine that someone who has been caught six times in five years has no regards for anyone on the road, least of all themselves, and that they have not witnessed, or experienced, the horrible effects that a death of a loved one caused by a speeding driver can have on those left behind.

    I have, and eight months later, it hasn't got any easier.

    Even if you "only" kill (or seriously injure) yourself, do you not think about the effect it would have on your family?

    I just do not understand why people are proud off "getting off" a speeding fine. I bet you wouldn't be so proud if you killed someone.

    Returning to the OP's query, I believe that her circumstances were extremely "special" (for want of a better word) and that a punishment shouldn't be given out. I wish her the best in getting it sorted.

    The fact that hankc35 has not been prosecuted could be down to lack of evidence. The Police can always find an easier target.

    If the speed was considered dangerous, the Police would have taken the matter further.

    As for intentionally speeding, I do this on motorways. Usually stick to an indicated 85mph. Doing 70 is dangerous.
