Just had barclaycard phone up about an account that we put in dispute a few months ago. They are telling me something about their solicitors finding that barclays do not have to send a full cca as at the time application forms only were signed. He was then trying to be very insistent that we paid some money. I told him to put all the info he was telling me into a letter and I will look into it. He refused to do this telling me that it has to be sorted today or they are going to sell the debt onto a collection agency and the next step is doorstep collections. Have I done the right thing in insisting I see all the info he was coming out with in wrilting first?Make £5 a day in May total so far £20

You have done the right thing, they are liars and breaking the law in using such tactics....
Next time just say 'bear with me' and leave the phone on the side, ignoring them - just carry on with whatever you were doing.
If they write to you let us know what they say/threaten - but they have no rights, they are in default of your s.78 request thus meaning the debt is unenforceable until such time they comply, properly.

well tescos personal finance replied to me....... well when i say replied... I havent actually had a reply from them, but Triton credit services, which are obv just another divison of rbs anyway!
but they are saying its a formal demand for the balance, and that it must be paid immediately.... or to contact them for options.
im so peed off that they have not even acknowledged the huge letter i sent to them yet happily cashed the cheque! ggrrr
so comical though, i struggle to pay a token fee, so they ask for £2000+, cant pay that so they ask for £22000+ :eek:
any sugeestions poppet?? i was gonna send back a very similar letter to what i last sent tpf, my halifax card went like this to blair oliver and scott, and despite their harsh words on bright red paper i havent heard another word and just carried on paying what i could afford!Please be nice to all moneysavers!

Can you do me a favour and post the link to the last post of mine as I really cannot remember where you're at lol (too much going on).... but regards to Triton - if you've written and they have ignored you then just ignore them - they cannot do anything (if the account remains in dispute)
It may be worth sending them a copy of what you sent to the OC recently.....

the halifax card did have a correct agreement, but i have just continued paying BOS the same as i was paying halifax!
this is my first contact from triton, obv the letter i sent to tesco has just been ignored i think, which doesnt surprise me. i def think i will ping the same letter off to them. whether they'll listen i dont know.
its not a secured loan, but they do have a correct cca.as ive said im not trying to get out of paying them, just trying to negotiate some breathing space til i can get back to work and pay bit more!
Hi Guys, long time no see, had another setback following my op, but slowly getting better!!
just still catching up with whats happening but NID, i do have a question for youtechnically non cca related!
it regarding a personal loan with Tesco, been paying token payments all fine and dandy for last 12 month. they then contacted me wanting new payment proposals, so i upped it from £1 to £5 a month as we could just afford it.
all i had back was a letter demanding the arrears paid by 06/1/10, i wrote back if im only paying token how the hell did they expect £2000+ by then!!
then received a letter saying ok we cant accept your payment offer in this dept as its now being moved over to credit management services.....
today a letter dated the 15/1/10 has popped through the door demanding the full balance of the loan with interest by this saturday! :eek:
they do want us to ring them with payment proposals, which i wont do, only in writing.
i can only afford to pay a small amount each month, they have already marked me down as 8's with the CRA's.
i am drafting a letter to send back today to offer small payments again as they are threatening to commence legal action/ send a dca/ or start to set off or lien on any security that they hold (they dont have any, its unsecured)
im still not up to fighting form yet, and i would very very much appreciate your help with some tips on what to include with the letter to help me get through to them.never-in-doubt wrote: »Hiya

well yea, then just send Triton a copy of what you sent to Tesco and they 'should' follow suit and wait a response from Tesco.
