This is no help to the OP!

    His tax expired yesterday.

I thought you had 14 days to sort it and I have always got my cars renewed at the first opportunity after it has expired, this may have been 4-5 days after 1st of the month. Although now very easy to do online.
I don't know where you got that from. It's an offence to drive or keep* a car without exhibiting a licence even one day after your tax expires unless you've applied online or by phone on or before the day of expiry. In this case, 5 working days' grace will legally apply to allow the disc to arrive in the post.

    * without going into all the off-road and SORN issues of course.

I'll ask you again, since when has it been a crime not to have road tax?
Since Part III of the Vehicle Excise and Registration Act 1994. http://www.statutelaw.gov.uk/content.aspx?LegType=All+Legislation&title=excise&Year=1994&searchEnacted=0&extentMatchOnly=0&confersPower=0&blanketAmendment=0&sortAlpha=0&TYPE=QS&PageNumber=1&NavFrom=0&parentActiveTextDocId=2071654&ActiveTextDocId=2071699&filesize=189722 subject to its various exceptions and regulations.

Of course, no doubt you'll ingratiate us all with your infinite wisdom on how various posters have misworded their well intentioned posts

Dont you get fined £80 if its not renewed within the time unless its been declared sorn????

No, it's not done that fast. When you tax late (within the first month) you can buy a tax disc from the PO starting at the start of the month so by the end of the month the DVLA have no record of any unauthorised lapse in VED cover for your vehicle so no action is taken against you by the DVLA.

    From the DVLA site

    Postal Strike

DVLA is closely monitoring the Postal Strike to make sure that it does all it can to minimise disruption to its customers.
If you need to renew vehicle tax or declare a vehicle off-road, you can do it online or by phone. You can legally drive or keep your vehicle on the road while displaying your old tax disc for up to five working days, provided you have applied for a new disc before the old one expires.

Also there is no legal requirement to display the old tax disc under these circumstances.

Actually it's not a myth, but it only applies to being exempt from any further action against you taken by the DVLA. .....

The myth is that you have 14 days of grace during which you won't be done for being caught on the road with an out of date tax disc on your windscreen!

Failure to display a valid tax disc is an offence!

That could cost you £60 each time you're caught.

no excuse, dont be suprised if you get a fine

No excuse MON, you have been convicted.

To add in a sensible manor, the OP has not driven the car so has committed NO offence, if he/she renews online today all is good.

What is this grace period some posters are talking of?, today is the 1st of Nov Thats only 1 day??. Online taxing is instantaneous add valid from the moment the payment is excepted.

If you renew today surely you cannot possibly be done, unless you have already been caught
I like the thanks button, but ,please, an I agree button.

Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

Always expect the unexpected:eek:and then you won't be dissapointed

You can be done - for "failing to display", which is why the OP was advised not to follow your advice (to buy online), or drive today, and to get his tax disc from the post office tomorrow.

I think there have several posts on this previously, and judgements have been shown to proove that technology has over paced legislation.

I don't think the DVLA pursue issues on this footing any longer:confused:

You do not get convicted of failing to display or having no road fund licence IF you have paid on line before being "caught", unless you can show different that is?

You get a ticket for failure to display, not a bill from DVLA!
