    This is the email my dad used succesfully, (he didnt write it himself i dont think)

    email it to charles1.bacon@nationwide.co.uk

    I think my dad said it took 2 emails to this guy, and the day after the money was back into his account

    LETTER BEFORE ACTION

    Dear Sir/Madam,

    ACCOUNT NUMBER:

    I now understand that the regime of 'fees' which you have been applying to my Flex account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law and contrary to Statute.

    I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

    I am frankly shocked that you have operated the account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary.

    I calculate that you have taken £609.50 from my account since 19th April 2002


    I require repayment of this money. If you do not return it to me in full within 14 days that I shall begin a claim against you for the full amount plus interest plus my costs and without further notice.

    You need to send another letter before that one, also allowing 14 days (the CAG refer to it as the preliminary letter).

    If it ever came to court (unlikely but still possible), it is possible the judge would rule in the bank's favour as 14 days would not be deemed as a reasonable period for the bank to respond to the request for payment.

    Do join up the CAG as I mention above - it's free, and folks help each other out all the time.

    Hi Char, I`ve just registered here and have just sent my first letter to Nationwide. Have you had any progress with them yet? My letter posted on 22nd June. I reckon I`m owed thousands over 6 years!£1500 in the last 16 months::eek: Looking forward to seeing some results too!

    I used secure messaging via internet banking first letter sent 14th june, as yet no reply yet it says they aim to respond within 5 working days.... Sent 4 more since then and nothing.

    Hi there - funny that cos I also done that on 11th June then went ahead and posted the dpa letter on 22nd June recorded delivery - just to make sure -maybe they`re very busy sorting out the thousands of complaints that have hopefully just arrived:rotfl:

    Just tried to find a page I saw earlier on their site to do with listening to their customers. 'Commercial and Communications Director, Stuart Bernau and Divisional Director Customer Service and Communications, Charles Reed' will be online to answer any questions so I have e-mailed them about their communications or lack of them. Wonder if I will get a reply! Its on the 3rd July at 6.30pm to 7.30pm.....

    Thanks Chatta, looking forward to that one if I get a chance.I`m interested to see how things progress - could do with a holiday :-) - most of our unlawful charges were made when we were at our worst financially. And we`ve had a rough time lately with business insolvency,unemployment, debt ... dare I go on.Its made me more determined to get back what I`m owed.Am also claiming on 4 mis-sold endownment policies.

    Good luck with the endowments I want to have a go with that as well but doing one thing at a time. Glad you found the live chat with them I had to go back into history to find it. Funny how you stumble across things when you are surfing net...

    Be careful you dont have a deadline on claiming on the endowments. mine is 10 July with Pheonix. Just made it there hopefully! Will pop in again soon and keep track on any other Anti-Nationwiders.

    Hi, recieved a letter yesterday from Nationwide saying that the last 6 years info will be with me in due course.Look forward to recieving it and not looking forward to working out the interest. Anyone in the same position?
