    As a child or young person, you cannot normally be taken to court for debt. This is because you cannot be legally held to a contract you make when you are under 18. However, there are some exceptions to this rule. You can be held legally responsible for any debts you run up to buy things that you need like food, shelter or clothing.
    There may be other debts you can be held legally responsible for. If in doubt, consult an experienced adviser, for example, at a Citizens Advice Bureau. To search for details of your nearest CAB, including those that can give advice by e-mail, click on


    You can borrow money at any age, but access to loans may be limited because a lender will not usually be able to take a young person to court if they break the terms of a loan. This is because you cannot usually be legally held to a contract you make when you are under 18.


    Notice the terms "not usually" which implies it can happen. Since your mate who was over 18 formed the contract, i definitely wouldnt ignore the payment demands. Young people can legally enter into contracts. But of course it depends what the contract is for.

    i just got a letter this week saying that the debt collectors were coming and i owed them 356, didnht say if it was pounds pence or us dollars!!! i have contacted citizens advice and trading standards and basically they have said this company does not have a leg to stand on! dont pay any money and dont give any card details cos they will probz go and take the money anyway. i was the lead person aswell and havent received an invoice or anythinglike that. the rep rang me a week after our hol in july and i told her we wernt going and losing the deposit was fine, nothing like this was mentioened! keep posted what happens, get in touch with citizens advice...08454040506 xx

    Just to check - are we talking about debt collectors or bailiffs? As far as I am concerned debt collectors can be safely ignored. Bailiffs on the other hand can not.

  • I'm having the same problem too. Me and my friend went to Magaluf this June and at an all-you-can-drink event at BCM bar a rep swooped on us. He firstly sold to us a bar crawl for the following night for 10 euros each, to we which we both wanted to do so we paid the money and then he said about the reunion. We said we weren't interested but after him hounding us for about 10 minutes we gave in just to get rid of him. At no point did he tell us that we wouldn't be able to cancel and said that the 10 euros we had paid for the bar crawl would act as the deposit for the reunion. Now I totally forgot about this reunion, never received an invoice, then 3 months after we had got back they started ringing day after day demanding that we paid. I have received another call today whereby I told the rep I would not be paying a penny and that I hadn't received an invoice. She said that everyone had been sent an invoice and that she had never come across a situation like this (as if!!). Also that if the balance wasn't paid by Friday she would pass it to a debt recovery agency. This got me panicking but after reading on here I will just await this 'agency' because I don't think they'll have a leg to stand on.

  • Hi there, this has just happened to me, and so far, I have found neither tradinds standards or my local citezens advice to be very helpful at all, they have advised me that because the booking form was signed that we will find it very difficult to get out of paying, all i have been told is to offer them a smaller settlement in order to get them off our backs, but I dont see why we should have to pay anything as we were falsely provoked into the contract, any thoughts? would be very grateful for any help, Thanks
  • Hi Lynsey, you must be bein charged for the same reunion as me, as you can see in my post I am very worried as trading standards have left me in doubt, I havent rang the company directly as yet and I also didnt recieve and invoice, now I have been sent a letter along with a copy of the form i signed and a list of t&c's, not really sure what to do, just wait it out or maybe send them a letter.

    My son is also getting letters demanding he pay the balance for himself and 3 friends as he is the lead name, my advice to him and to everyone else is tell them to whistle.
    Maybe someone wiser could tell me if a contract entered into in spain is valid in the uk especially when it is obvious most if not all of the people signing up were probably pi**ed up

  • i'm not sure if it's still valid when it's in spain, i rang the company yesterday and they told me that rather than paying the 267 i 'owe' them, we have the option to pay a cancellation fee of £45 each, making it 135 instead, one thing i've noticed from looking at this thread is that not one person has actually said that debt collectors have been involved, so i'm quite tempted to wait and see what happens. Another thing I have noticed is that they have gone against their 'terms and conditions' by not sending an invoice, so i'm wondering if that would make any difference?
  • i got a phone call from someone at thier company last night, demanding the money and when i was going to pay it. when i said i hadnt got an invoice she got all flustered and said i must have done, she nearli had a break down when i said i didnt belive the company was real as i have found 6 different names that its trading under!! is everyone just ignorin what theyre sayin cos am gettin canny worried now! ive just sent them a letter saying am not payin a penny etc and have asked for letter to be sent to me within 7 says sayin the contract is terminated, but doubt it will hapen! thanks x
