    I think your letter is fine.

    Send it recorded of course... and perhaps send it to BOTH addresses just to make sure.

    Do you have a phone number that would match the dialing code for either Preston or Burton?

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

  • Thanks for your replies. My friend has sent the letter to both offices via Recorded Delivery, but they took the money out of his account on Monday with no authorisation.

    Is there anything he can do? I've recommneded going into the bank and getting the transaction reversed but when he called them they weren't too keen, due to him giving the card details to secure the deposit.

    Hi .... depends what he signed .... but my attitude is that they shouldn't have kept the cc details ... kick a fuss up with bank!!

  • I wouldn't worry about them, The big boss of the company , he is full of hot air and has a bad repution for not paying people, its just a matter of time before they are on watchdog or rogue traders!
  • Interesting, my son who was 16 at the time, signed one of these with a 17 year old friend, despite their ages we are on letter 2 final demands - this company is unscrupulous in its contracts - if you are under 18 they are un-enforcable, if you are over 18 and do not wish to go you may be able to fight under "unfair contracts law" following example letter:

    The contract between D Noble and GHPE ltd is not enforceable as it is not a contract signed under “necessities” - your representative obtained the signature from a “minor” with no adult representation - minors and contract law.

    The terms of your contract, even if enforceable - are in breach of the “Sale of Goods Act 1979” and “unfair contract terms”. To be legally enforceable it must be proven the terms within the contract are “fair” to all parties venturing into the agreement. The terms within your contract leave the consumer at an unfair disadvantage.

    We have reported your business to the “Trading Standards” and “Office of Fair Trading” who will continue to monitor your business practices on behalf of the consumer.

    It is quite right and proper that any deposit may be deemed forfeited - consideration will be taken to approach the courts for a small claim against you for the deposit together with costs should you wish to pursue this matter, the defence of which will mirror that of our complaint to OFT and the hearing will be in Poole County Court, incurring substantial costs to your company to appear.

    Companies House shows you are a new company with no trading history, also information submitted to OFT.

    we then sent this letter after another nasty letter about debt collectors coming to our door:

    Dear Sirs

    Further to your second and final notice of intention letter please find our reply as follows:

    Firstly, we attach our original letter which seems to have been ignored, drawing your attention to the basis of contract law your company appears to have overlooked.

    Secondly, you are mis quoting the commercial debts regulations 2002, we are not a company and have no employees.

    Your company is trading in breach of Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations 1999. We are now officially cancelling our places on the BCM reunion, therefore forfeiting our deposits.
    Should you wish to continue in your unprofessional method of trading and pursuing this disputed debt your consideration is drawn to Protection from Harrassment Act 1997.

    Any representative or persons appointed by your company "visiting our property to collect this debt" will be informed it is in dispute, so only increasing your costs.

    The Office of Fair Trading are receiving a copy of this email to support our complaint against you and your unfair and illegal trading practices with MINORS.

    We trust that the action is swift on their part to ensure others are prevented from similar situations.

    Any continuation and harrassment from you will leave us no option but to dowload a register of your directors and address them personally with legal action.

    I am posting all information to the web to ensure people are fully aware of their rights, and do not give in to blackmail and mis-quotation of the law to force children to part with their hard saved or earned money.

  • This company is awful my daughter and 3 friends attended this party on the 13th November 2009 . The were told on arrival they all had to pay £30 cash room deposit that they would get back once the room had been checked after their departure .They handed in the receipt when they left and were told they would be called to get the £120 cash room deposit back . They have never called . I have now paid for small claims court to see if i can get the deposit back from this company , this was over to weeks ago and still no response. This company continues to call my daughter and ask if she wants to attend the next party and that they can use the room deposit for the deposit for the next party. Sha has said she does not want to do this and wants the £120 cash room deposit that they all paid refunded.. they say she has to speak to the office as they cant refund the money ...... There were 6 other people that attended with her and they cant get their deposit bcak either ... Over 2000 people attended this event ...makes you wonder if any of them got there deposits back ??? not sure what to do if they do not respond to my small claims ... any advice , many thanks

    Hi Smiller - if that's your address in your post, I would take it out (you can edit and resave without the details). You can't be too careful and you don't want people from here being able to identify you offline.
  • I am having the exact same problem, they have been hounding me for cash, threatening me with debt collectors today. I told the woman I would pay my share (£89) and gave her the numbers of the other girls and said I wanted nothing more to do with it. But now I'm scared they're going to go ahead and take all the money out of my account anyway. When we were in magaluf we were misled and the word contract was never mentioned, more that we were signing up to an information leaflet about it. I as the leading party member also never received an invoice which I am meant to as stated in the t's&c's on the website. Any advice?
