Agree with scullster. If Argos advised you to get a cooker that is inadequate for your flat, then they are responsible. There's a storm coming, Mr Johnson. You and your friends better batten down the hatches, because when it hits, you're all gonna wonder how you ever thought you could live so large and leave so little for the rest of us.0

Perhaps your right, I'm in a good mood today.
I've only scan read the thread (which admittedly is a crime;)) but I've qualified my response - if the OP is being a little economical with the truth, then let it be on his conscience if he pursues my advice.
My advice though stands0 -

Thank you all for the replies so far let me clarify a few points (with bullet points !)
1) We ordered the "wrong" cooker on the live telephone call advice of the sales assistance (Not knowing the differences between the different gas types we decided called sales who we thought would be able to advise use, they did a brilliant job about the FSD !! but not about the types of gas, I mean we have just moved in to a new flat and threw away our old cooker, shame on us for wanting a new cooker for a new flat !
2) We paid for 2 gas safety certified engineers (http://www.gassaferegister.co.uk/advice/gas_certificates.aspx) to come out (Who both left letters to say it's faulty) and who said contact the manufacturer which we then done.
3) After the manufacturers engineer came out they saw immediatly that it was a LPG and said that "It should not of been sold it as we live in flats and this model is for caravans, they should of told you that when ordering as they understood you needed a FSD which is a legal requirement for flats"
4) We understand that there is no return / refund for white appliances but we dont want a refund, we just want it exchanged for the correct model (Which if you look at the 2 different models on their website you will see that they are VERY similer in model and description and which I think the sales person got confused with)
5) We have paid already 220 pounds for 2 x gas safety registered engineers to come out, now we are being told tuff luck it is our mistake ! even though we were told which model to take ? It just doesnt seem fair, we didnt make the mistake, yes if we would of researched more we would of realised what LPG stands for but at the time when your on the phone you kind of take the other sales persons word as truth (they stopped us from ordering a cooker that didnt have a FSD, so who were we not to beleive them !). I am fed up of cooking a feeding my 4 year old son on a goerge forman grill ! and just want a blinking sunday roast !!0 -
Under the clarified circumstance, Argos are at fault. Call their bluff, call them back (you will probably hear the "your call may be recorded for training purposes), refer them to that message and ask that they go back to their call archives, retrieve the call and see that they incorrectly advised you.
The question of which product number you ordered is wholly irrelevant if they advised you in the same phone call that the product you initially tried to order was not suitable, and that they then advised you which product to buy. It is unreasonable for them to expect you to then double check the catalogue entry for the new appliance to confirm it is fit for purpose especially as, in the process of advising you, they have come across as more knowledgable about the product and its installation requirements.
As they are sellers of the appliance, the court would take the view that they should be more knowledgable about the products they are selling, more so than you.
If there is apparently no recording, whilst it is your word against there's, your story stacks up to me. I'd back you!
I agree with this view, I cannot believe people are trying to heap the blame on to the OP if argos specifically reccomended this model.0 -
Robo,
Have I missed something - why pay for 2 engineers to come out, wasn't 1 enough?
My advice stands as Argos have missold you, call them. However, I think that this will now be a matter for the small claims court because you are claiming for both a replacement cooker and out of pocket expenses.
If you get nowhere with the phone call, send the letter outlining your claim but keeping it as brief and factual as possible - give them 14d to settle the issue, advising them that if they don't, you will be pursuing them through the courts.
If you can last 14d without the cooker, you are seeking a replacement. If it goes beyond 14d, you will be taking them to caught for a full refund and the out of pocket expenses as you will have bought a cooker from elsewhere by then.0 -
Why pay for any? On the Argos site it says connection is included in the price.
Arrghhhhh thats the whole point, for this model there WAS NO installation available !!! or we would of included it when we 1st ordered it ! and this whole mess would of been avoided ! but we were told to get this model !!!
I cant stress anymore that we were told to get this model, on the phone when ordering the sales person told us this, I am out of pocket by over 200 having paid for 2 x gas safety engineers to come out and "try" to install both said the cooker is faulty, I phoned the gas safety website and they recommended the local certified installers in my area, who both said (and didnt diagniose it as being the wrong model, they even left letters to say so !), he last one said to contact the manufacturer as its clearly faulty, hence I am not at a position where I cant return it and cant get it exchanged.0
