just so someone will take note this site creating demand and you not getting your hamster stock, nearly 700,000 have viewed this thread but only 12000 posted. Do you not see you are providing the information to others about where the stock is now. if you want it start pm ing not posting
I think this was discussed in a round about way the other day and, some may be able to add more to this, but I think there were 4 main issues identified by several posters contributing to the discussion (i wasnt one of them so don't have a go at me anyone): 1) by the time you pm people, the stock will have sold out anyway; 2) how do you select which people to pm and which not too, and by the time you've pm'd the last one, they'll have missed out anyway; 3) how would anyone know that someone they pm'd wasn't really buying to sell on or may be they would suddenly e mail all their mates; and 4) just because someone doesn't contribute doesn't mean they are any less entitled to buy something for their child than someone who does.:snow_laug Maximouse loves the build up to Christmas :santa2:0 -

The seller isn't selling anything else, so I am assuming it's someone who bought hammies but their children weren't very interested. I can't get into their 'other items' but when I checked a few days ago it was either 1 other auction that wasn't gogo pets, or nothing, I can't remember which (I looked at so many mr squiggles that night!).

:mad: when you advocate cheating people out of money and defraud RM, you have a nerve to diss sellers who start auctions at 99p. in todays market, the majority of my items start at 99p, not to avoid listing fees, but in actual fact to attract buyers. MOST people who buy from ebay, are looking for bargains. If you are a good honest seller, people will add you to favourites and come back time and time again.:xmastree:0 -
i know but as a seller it makes me soooooooooooooooooooooo angry!!!!!!!!!!!!as i said i care about keeping my 100% feedback and have sold hundreds of things!!!!!!!!!!!!!i have only screwed up once...selling 3 GH guitars on a worldwide post of (estimated) £20 postage and ran all the way to the PO with 3 of them to spain etc...to find out the postage was £33!!!!!!!!!!!!!!!!!!!!which i paid!!made about 20p profit!!!!!!!!!but i do start auctions at what i want to AT LEAST get!none of this 99p fee listing malarkey
Hi lors, it is a pain when that happens. It does seem unfair when good people get ripped off and I'm glad you did the right thing and posted the guitars off.
I guestimate postage sometimes and have lost out but grin and bear it.

No. Not that enough people couldn't get on. But the buyer was put at a distinct disadvantage due to a fault with the auction software. This frustrated the contract with the potentional buyer.
Get a few more books out!! If you want me to dig mine out I will.

Frustration occurs AFTER a contract has completed and where it is impossible for one party to perform their obligations. It's not about whether an auction site was only available to a few thousand people so the seller didn't get the price he wanted! The contract is not impossible to perform now! The seller has the goods, the buyer has contracted to buy them - during the period that is claimed "the site was down"....
The seller set the start price at 99p - I think the argument would go, if he wanted more, he should have asked for more, rather than trying to avoid listing fees.
Getting technical:
Lord Radcliffe in Davis Contractors Ltd v Fareham Urban District Council:
"Frustration occurs whenever the law recognises that without default of either party a contractual obligation has become incapable of being performed because the circumstances in which performance is called for would render it a thing radically different from that which was undertaken by the contract... it was not this that I promised to do".
Well the seller promised to sell the goods to the highest bidder at the end of the auction! The buyer took a risk on what price he would get. The site was not down, people were getting on it! I don't think it matters that the seller didn't get as wide an audience as he would like!
Here is the summary from the University of London course manual in contract:
The Doctrine of Frustration operates to relieve parties of any further obligations under a contract. It applies when some event which is not the responsibility of either party has made performance of the contract impossible, or radically different from what was originally agreed. Examples of events which will lead to frustration include destruction of the subject matter, the non-occurence of an event, outbreak of war and government intervention. The contract will not be frustrated if the performance is simply made more difficult or expensive, or if a significant part of the contract survives the frustrating event.
I really am failing to see how this is frustration!0
