Changing Name after Divorce

    So if you changed you birth surname to something else by deed poll, then married, then divorced - do you not have the automatic right to use your deed poll surname :confused: ? (hope thats not too confusing! )
    I know you cant go back to your maiden/birth surname as you have relinquished all rights to it.

    My mother-in-law has been married 5 times and after each divorce gone back to her maiden name. I have no clue what her present surname is as I haven't seen her in 10 years but If I stick to her maiden name I would find her I am sure...

    I'm with those who say you can call yourself anything you like as long as it's not for fraudulent purposes.

  • I have difficulty with my name/s. I was brought up from age 1 as Joan Smith, but my birth certificate says Joan Jones. Everyone knows me as Joan Smith, but when asked to provide documentary evidence of my identity (I've never married, have no driving license or passport) it gets really sticky....

    This is correct, you can, But official organisations such as banks, credit cards, dvla, passport etc want to see documentarty evidence of the name change. I wrote/phoned and said I want to now bw knows as XXXXX and they said we cannot make any chenges to your name without seeing original documents of the change.
    Usually for the purposes of changing back to Name on birth cert then decree absolute and your birth cert will suffice. As I was changing to my name before marriage (but not on my birth cert) I had to get deed poll done.

    I didn't change my name when I got married but on divorce changed my two children's names to mine. (they were both under three so only notified the medical centre). never had a problem with their birth certificates having a different name (dad's) - so was able to enrol them in school, get a passport etc etc. Only query came up when a savings fund matured that had been taken out when my daughter was born- but I only had to send in my birth certificate with a letter confirming the change.

    You can call yourself what you like so long as it's not for fraudulent purposes, and inform bank .... I'd had my name for so long that I really didn't want to let go of it when I got married, so I just added my husbands on the end of mine - which has caused some problems but at least people never forget my name :D
