The above is totally meaningless in this sense, It is used for when the law produces an absurdity. In the case of the RTA 1988 the requirment is clear. No absurdity, no use of for the above to be applied.
Confusion accepted I do have a problem with my system as it stands at present, if I put too much info up it crashes leaving nothing, hence short posts added to later.

No, he wasn't. Lifted directly from my brand new coppy of butterworth's;In Hallinan v DPP1 a passenger had fallen and injured herself when the bus on which she was travelling halted sharply. No damage was caused to any property nor injury suffered by anyone else. The High Court held that the bus driver had to stop his vehicle.
There's another one regarding the duty to stop, again lifted directly from butterworth's;In McDermott v DPP (1996) 161 JP 244, [1997] RTR 474 the defendant stopped 80 yards from the scene of the accident, to which he immediately walked back. The High Court upheld the justices' finding that he had not stopped as required by law.
It really is that simple. You must stop at the scene.

So, if you're going to abuse me.... you may as well know who I am. My names Paul and I serve in the 8th Marine regiment. I served in Iraq until 4 weeks ago when an IED blew my foot off at the side of a road in Al A'zamiyah. I returned to Selly Oak in Birmingham (about 243 miles away from my family) where I still am, undergoing treatment. My first post was because i'm bored shitless in the hospital and I need something t get into. I saw your post and thought you're unfair in talking to people like you do. I've been killing people for 16 weeks and never spoke to or about them in the undignified manner you talk to people you dont even know on here.
So, you know me. Am I still a !!!!!!? !!!!!!? Maybe now you know me you could take the !!!! out my !!!!! attempt to walk on one foot? If you must take the p i s s..... w a n k e r, No....... Stumpy...... Yes.
Edited for info, I was out with my mate. They came home on 11th Oct and visited me at the Hospital. I went downstairs for my night out with them to the coffee bar where I told them what i've been up to. Getting abuse on this bloody forum on my poxy little iPhone! They were !!!!ing themselves!0 -

Ok Paul, let me say it would be very easy for me to say how sorry I am, I should not have posted that, I was unfair to you. But that would have been hypocritical, and I am not a hypocrite. What I can of course say is that if I had known of you issues I would have made allowances and certainly not posted the way I did. I did apologise to you after an earlier post but as said in your opening post you say “now who’s the !!!!!!?”, well it’s a bit of a red rag.
There will not be a single member on a forum like this that does not have the greatest of sympathy with you, and put me at the top of the list. I just hope you get the fair compensation from the excuse for military compensation that we have in place in this country, not that any financial award will rectify your loss.
You are a lot younger than me, but I have a nephew that I look on almost as a son, only having daughters myself. He returned home from his 2nd tour of Iraq about 6 months ago. Yes he came back physically intact, but he wasn’t the same, he was mentally scared and has gone from being an outgoing bubbly young chap to a very quite introvert. He will not talk to anyone about what happened out there, even his actual father. You all have my respect.
Lastly, regarding the frustrations, no I haven’t lost a foot and I’m no war hero but I do know about the pain and anxiety that hospitalisation entails. This will sound like me comparing my own situation to yours, I’m not, please understand stand that. But 2 years ago I went into hospital for a back operation, major operation but routine. My health was otherwise fine. Unfortunately they damaged the nerves in one of my legs, giving me a dropped foot, little feeling in that leg and a weak ankle that gives way continuously. I know how you must be feeling.
I wish you a speedy and maximum recovery, I don’t think I could have done your job.:T:T:TI like the thanks button, but ,please, an I agree button.
