Carphone warehouse have a mean refund policy

hello all,
Carphone warehouse are not my best friends at the moment.
I purchased a new handset in one of there stores on 19th September.
Over the last three weeks i have experienced problems with the handset. My text messages kept erasing from the phone and the message centre number also kept erasing, meaning text messaging was impossible.
I telephoned there customer service centre and was told i could get a replacement because they have some sort of 28 day policy or something.
Anyway, drove to my nearest store, the staff were really friendly and helpful, they had my model on stock, but only in PINK. Fear for my street cred, i passed and asked for a refund, it seems carephone warehouse dont refund there customers.
I asked if i can have a different model, "no sir, carephone warehouse only exchange like for like" I was wondering if this policy is legal??
I assumed if you buy a phone and it develops are fault your entitled to a full refund????
the manager told me another store had my phone in stock. I asked if they could transport the phone from one store to another. NOPE NOPE NOPE
had to make my own way there by a 15 min drive.
It just seems, the company takes your money, and leaves you when things go wrong, any thoughts anyone???

you have 14 days to return the phone and get a full refund it stated that in there policy and these are set by the networks and not carphone warehouse after that an exchange is available but at the stores descretionReplies to posts are always welcome, If I have made a mistake in the post, I am human, tell me nicely and it will be corrected. you dontr need to sign anything its the smae with pay as you go as it is with contract
there policy is in line with the sales of goods act

Just go back to them until they get you a working phone. Within 28 days i believe it is a replacement. After that it becomes a repair/refurbished one. Just remember when you went in, so next time you go you can state you notified them of the fault with the first 28 days, but they were out of stock so you were waiting.
You don't have to accept pink as it is not like or like. If they continue to fail to have it in stock, then you should be able to get an exchange for a similar phone.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
ok, although the thought of having no phone, paying more money to send and what with the post as it is, that does not sound attractive to me

I doubt you will get a refund, as you have gone past the 7/14 day period. In addition I doubt you can cancel your contract unless you speak to the operator but it is unlikely they will help.
I don't believe their is a set time they have to allow for refunds, i know large stores like Argos, ASDA, give 28 days to return it if it is unused.
