    They cannot assess you based on your partner's income alone - under any of the schemes they have running!! I wonder if they are using out of date info - have you asked them on what basis they have assessed considering you have no income?

  • Kelloggs - Yeah I did ask how they can assess me for anything since i've not been working, however the girl at the end of the phone advised that "your caseworker isn't here, i'll tell her to call you", When I advised I wanted it in letter form she agreed and nothing. I've just carried on making arrears payments an since this assessment and demand for money they've not written to me to ask why im not paying the full amount. I hope it's because the girl at the other end of the phone took on boiard that I am not working!

    Dancing Shoes: I don't claim tax credits because my ex works for the dept involved and has abused the job to find out info about me and new partner - then used this info to harrass us both. As far as I am concerned these benefits allow my ex far too much info about me, despite them acknowledging this has been done they've not acted upon this and they still work there - I feel there is no way that I am prepared to give away my privacy so I just won't claim!

    Sorry, I was just curious. Did you follow it up with the head office department? In most places data protection issues are a sackable offence if abused. I tend to find that threatening the relevent company with civil action has the required effect;)

    The managers there know all about it, the police have even contacted them and threatened to place a trace on the system if it continued, however when initally approached the bosses there denied it could happen and only afterwards did they say we will keep an eye out to ensure their system isn't abused. There certainly wasn't a sacking.

    It is easily traceable if they have accessed information they shouldn't have. Eg in the CSA (for example) they have a card which they have to access the computers, and each card is personal to them. Every time they access a case, it is logged and can be traced to the date, time and who accessed the case. Every so often also, there is a case check - random but whoever has attempted to access the case has to write it down and get it authorised by a manager so they can continue their work. It is not possible to know in advance which cases will be checked, so in theory nobody would take the chance on accessing something they shouldn't as it could be just the time when it flags up a check and they will have some explaining to do. Anybody who has a CSA case and are staff, have to declare it and their case is then made sensitive so that they cannot ever access the details of their case.

    You need to contact them again and ask what details they are using - and remind them that you have a nil income so should be assessed at nil.

    did you know ALL commumnication is recorded, ALL calls are logged, ALL times, ALL notes on the system ect., you have a right by law to request all info about you, all calls, all notes ect.

    I will do, however will the LO go ahead on the basis that I owe what they are saying and can I reduce it after a LO goes ahead??

    I love that all info is recorded and all notes... but when you ask them to trace info supposedly sent no one can ever find it! I have already requested my DP files, found info on deadbeatdads which advised how to do. I've not heard anything yet, but it's been less than 40 days.

    In respect of breach of info. They admitted it could have happened when police spoke to them, when I spoke to HR they said "no way, you must be wrong!!". I chose not to take it any further because there is a child involved, instead I wanted to let them know that they would be monitored and the police would be happy to prosecute should it continue. Luckily all ceased once they knew police were involved and had spoken to their employer.
