The interpretation of the law is in question, the officer could have issued me with a ticket and ask me to have it repaired before driving. Instead they terminated my MoT and now I have to have it re-mot. If I go to court then the car is an evidence and need to be in a state when the ticket was written.
I need the car so I must hire one and leave it to my solicitor to claim it.

Anihilator, next time you get one of these pink ticket because your Brake light switch broke during the journey, and you were banned from taking it to a garage unless you hired a truck to take it there, then you will know how I feel. The costs are huge, I need to claim that as well.

This case may set a precedent, then if they win then you all will be getting these tickets from time to time. I think we should finished the thread.

    1) I am guessing he terminated the MOT because your car is a poorly maintained heap and he wasnt convinced it was roadworthy even with the lights fixed and wanted the reassurance for public safety of a new MOT.

    2) And? Do you really think the police should be liable for a hire car for you because you poorly maintained your car and it needs fixed and they noticed it before you? You are on a different planet.

    3) You cant claim the costs. The police officer did nothing wrong. It isnt their fault your car broke. This is what brakedown cover is for. I also doubt I will have the same problem as 1) I dont have a heap, 2) I would notice very quickly if I had no brake lights 3) I have breakdown cover and 4) I am not an obnoxious moron who would upset the police officer so he didnt want to help

    5) No it didnt set a precedent. This has always been a criminal offence punishable with these actions. You certainly arent the first to be charged for it either. The officers have discretion and normally as long as they are happy your car is safe and you didnt knowingly drive it in that state they tend to send you on the way to the nearest garage.

I am actually worried people like you are on the road.

    There, there, there,
A six year old car with a brand new MoT is not a heap, or may be it is, who cares.
If calling me an obnoxious moron makes you feel better then p*** off.
    Sleep well

I am waiting to hear from my solicitor and the IPCC to see what advice they give.

Well any complaint you make will NOT be dealt with until you have either payed the ticket or been dealt with at court. No need to wait any longer on that score.

Having no Brake lights can be dangerous if other drivers do not have eyes.

Can anyone please tell me of any eyeless drivers who legally hold a DVLA licence?

    Apologies Chippies Minton,
I meant drivers who did not observe the road and see where they were going and not keeping their distance. If someone is going to run into you then they will, with or without the brake light.

The chances are they are more likely to run into you without brake lights.

in that case, we may as well all sell our brake lights on eBay. It's the future of driving! I'm going to make a fortune!

There is no need to be silly or emotional about someone being picked on by the Police.
