I was stopped by the police once as they noticed one of my brake lights were not working. I did actually check before setting off that both worked, so the bulb had become defective while I was driving/braking.

I explained to the officer that I did check all the lights (as I always do) before setting off and they were all fine. He let me off after checking the rest of my vehicle and discovering I had a clean licence.

I do believe that the officer was a bit harsh with the OP, and that a warning would have been enough.

But the OP had no brake lights!!! not just one

I cant believe the amount of people who think the OP should have been allowed to drive off with no brake lights at all.

You have been harshly treated - no two ways about it. There seems to be no give anymore just take take take! As you say, easily trackable motorists seem to be an easy target.

In your answer you say there is no give and take anymore? what you mean is when someone takes you dont like it and only want others to give?

So what has the police officer done which is worthy of a complaint, and complaint exactly of what?

An offence was commited which carries a certain punishment, this gave the officer different options to deal with it and he chose a particular route ? simple, and unfortunatly we only ever get one side of the story, either flowered up or drip fed, so is it time to all pack up and never ever prosecute, or only to those who deserve it? and who defines that.

Clearly the police officer felt a prosecution was the thing to get it through to this character that you cant drive around for months without regard to your own vehicle and clearly when asked when did you last check it? I imagine the answer was July., really bright, or at least brighter than his brake lights

The mechanics have found that the Brake switch had broken off, I had to be a wizard to know that. Any way I am hiring a car and will ask my solicitor to send the bill to Police, will this be ok?

So why are you hiring a car? Why not just get it fixed?

I think it would be a great idea to send the bill to the police....

    Sorry, just re-read the thread.

Yeah, I guess he should have noticed that if it had been the case for 2 months.

why would only a wizard know if your brake lights were working? can you not see?
why are you hiring a car? get a new switch for a few £ and use your own car.
why should the police/taxpayer fund this?

does anyone else think we have found the student phil of the motoring board?

  • The interpretation of the law is in question, the officer could have issued me with a ticket and ask me to have it repaired before driving. Instead they terminated my MoT and now I have to have it re-mot. If I go to court then the car is an evidence and need to be in a state when the ticket was written.
I need the car so I must hire one and leave it to my solicitor to claim it.

Anihilator, next time you get one of these pink ticket because your Brake light switch broke during the journey, and you were banned from taking it to a garage unless you hired a truck to take it there, then you will know how I feel. The costs are huge, I need to claim that as well.

This case may set a precedent, then if they win then you all will be getting these tickets from time to time. I think we should finished the thread.
