Vendor is taking the kichen sink!!

    Did they mention this from the start? Was the kitchen mentioned in the EAs advertisement? If so, reduce the price offered accordingly.

    I think the lender will definately have problems with it. A sink is the key part of what makes a kitchen- not the cupboards, not the oven....

    Let us know how you go on. If the lender wont lend I think youll find that they will leaveit if they want this, or any othersale to progress !

    I thought it was supposed to be 'everything BUT the kitchen sink!'

    We have a similar problem, where the EA particulars state fire and surround, and fitted kitchen appliances were included, now having recieved the F&F form, several things are only available at an additional specified cost!!

    EA advises that some vendors do change their mind, and that the particulars were 'signed off' by the vendors, so The EA have not 'knowlingly misrepresented'

    Its horrible when vendors get all picky with this and that, Ive been told its usually after the initial uphoria of finding a buyer, especially if they accepted a lower offer than the asking price, and want to claw back a few quid.

    Its swings and roundabouts though, as the survey could turn up something that would make the buyer reduce their offer.

    Taking the sink and fitted cupboards takes some beating though!

    It would make sense if they put in an alternative sink to replace it?
    Otherwise you might be left fighting their plumbing nightmare. How much water can come out of a mains pipe in a couple of hours?

    Most (all?) lenders will only lend on a house that is habitable. A house without a functioning kitchen (which includes a sink) would not normally be considered to be habitable.

    So if it was me, I'd agree to them taking the sink/units, but insist on them replacing them with something functional to meet the lender's criteria, AND I'd be asking for a reduced sale price to compensate me for the fact that I'd be having to go in and face the cost and upheaval of installing a new kitchen.

    For evey item that was originally said to be part of the sale and is now not included, reduce your offer by the cost of purchasing and fitting a new one.

    Could you agree for them to leave it in place until your new one arrives, then get them to collect it when you are ready? You could stipulate a reasonable maximum timescale (e.g. 6 weeks from exchange).
    Assuming there is a sink in the property they are moving to I doubt this would cause too many problems for them.

    But I definitely agree with tek-monkey that if this was not made clear from the start then your offer should drop by the cost of replacing it. Especially if it was in the original advert, but even if not unless you were told otherwise I think it's fair to assume they would be leaving it as part of the sale.

    Is the kitchen sink even on the standard F&F list, or is it assumed that it will stay?
    Maybe an analogy is light fittings? Vendors are allowed to remove light fittings, but it is their responsibility to replace them with pendant fittings. Following the same logic they should replace the kitchen sink they are taking.

    What's the deal with the chain? If you are chain-free on both sides you could have a long time between exchange and completion, allowing your new sink to arrive. But I can't see others in the chain settling for this.
