I agree totally, Phil would be a huge miss and a large void but I can see totally where he is coming from. Post's like this add to people thinking we're all takedowns, criminal minded thieves with a plan to cheat and laugh about it. I'm not feeding the trolls, i'm commenting on Phil's decision to lay low and why shouldn't he, the board is littered with how should I hide this, can you alter this to make it look a certain way. It's wrong!0 -
surely people posting up their soa's and having suggestions as to what to increase to use the maximum allowances is what is meant by using the rules to your advantage?0

I am amazed at how much folk like to try and claim the 'moral high ground!'
Knowing, or being advised, how much to declare, how much expenditure to claim, and, importantly, what NOT to say, isn't anything like 'benefit fraud' at all.
It is all about getting to understand the system we have entered into, and rightly, how to get the system to work to OUR advantage!
This whole MSE website...forums and all, is given over to this end.....how to make the system work for US.....whether it's bankruptcy, or stoozing credit cards!
{OR...taking advantage of Tesco's loopholes....don't see too many worrying about the moral issues with THAT one??]
But, whilst we are banging on about''cheating'', etc...I don't see ANYBODY, trolls or other worthy creatures, mentioning ANYTHING about the horrendous amounts of money that lie unclaimed, for benefits and entitlements, from the State!
Or the fact that, until VERY recently, the State did little to assist people in finding out, and claiming, that to which they were entitled!
If a person feels guilt at having to resort to Bankruptcy to clear debt, then that is something they have to deal with.
Perhaps people don't wish to admit [to themselves?] that in fact they have become victims of the financial world and its ethos?
Perhaps that smacks of a weakness?
Well, we all have our weaknesses, fears and tribulations.
The sorts of debt I read about constantly on this forum result [to me] from a general acceptance [which is 100% encouraged] of debt as an ESSENTIAL way of life...part and parcel of normal living.
It is what every telesales person in every branch of the financial industry want us to believe.
Especially when sales bonuses are involved.
The pressures exerted by family, peers, media, government, and trade have been, and still are, phenominal.
AND IT IS NO SIN TO HAVE SUCCOMBED.
Indeed, where the sin lies is with those in the financial industry whose sole motive is profit...at any expense.
For sure, we don't HAVE to sign on the dotted line.....but, like bankruptcy, signing for that extra line of credit sure gets us off the hook, eases the pressure....AT THE TIME!
As for references to adulthood, children and maturity.....I'm sorry but to me they smack of total tosh.
they have nothing whatsoever to do with how we as a group have dealt with the circumstances that have prevailed.
Indeed, it may well be somewhat hypocritical...if the Motoring forum is anything to go by..[and the attitude towards, as an example, ''exceeding the Speed limit''....and receiving a summons for the offence]....
Bankruptcy is a method of dealing with debt...[much of which actually hasn't passed through the Insolvent's hands..but lies with charges and excessive interest]......it is a financial tool......and has been used by ''less scrupulous'' companies for many years....to avoid, for example, guarentees, etc.
whilst we're at it, what about some trolls taking on ''divorce?''
Nope..the OP is expressing exuberance......and the 'cheating'' must rank a lowly second alongside ''taking a sickie'' from work.....or are we too morally responsible to ever do a thing like that????No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -
You give advice what they can and can not claim for.
If your washer blows up during bankruptcy you can not claim for a new one, it is for this reason the allowances during bankruptcy are higher than if you were in a IVA. You have no available credit for emergencies. You are allowed to claim for a holiday in BR but how many people take them? your more likely to keep the money to one side for emergencies.0 -
exactly - its not fraud or cheating the system or trying to get one over on the IS - it's making the (allowable) system work for us!0
 -
Exactly.....and like any other administration system, the OR is ticking boxes too.
Didn't know about the holiday, though...never claimed for that one.....and I managed to find enough to take my 10 year old son camping for a week!!!No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -
Hold on, i'm not getting at asking for what you can claim for on a SOA, I have had advice regarding that myself!
Moral highground.. piffle - it's laughable!! Have a search on the board, there's many a post about how to hide assets, how to make sure something isn't taken by the OR. I for one am sick of it and i'm entitled to my opinion without being preached about the moral highground, I am a bankrupt too you know. You don't bother me, say what you like, enjoy helping people get one over on the system (SOA help bloody not included!!)
This is the last i'm commenting on this, i'm not fighting over what I deem to be a cheat or a fraudster. Enough from me.. pmsl moral highground0 -
I would like to say good luck to Gazzles I am almost ready to submit my forms. I found myself in this situation in June 2008 following a job loss I picked myself up found another albeit about half the salery and got on with it but by then arrears had built up etc, today I find that I may loose my job if I go BR ? How good is that screwed if I do and screwed if I dont? Up until June 2008 my debts were (at the time )more than managable but when the river dries up your boat runs aground. So if I loose my job again what am I going to do? I have a small pension of £600 pm before tax and thanks to that I cant claim any state help how do I look after 2 kids on that?0

            There is no MORAL HIGHGROUND
I simply do not want:
A) anyone setting out on BR thinking they will get to keep their motorbikes or cars, end up keeping the majority of their surplus and having a easy time of BR when nothing is set in stone, it depends on your OR everyone is different and some people have a really hard time of BR. Be prepared for the worse and you wont be dissapointed.
B)dont want to encourage trolls on the board having a go at anyone as in fact it is them who take the moral high ground and can make someone feel awful when they are having a hard time of it as it is.
Thats the last i will say on this thread and hope it gets closed.0
