But Allan says he didn't buy a refurb/clearance one they emailed him that it was brand new and not a clearance one.
If he had knowingly purchased a clearance one I'm sure he would have known that.It's not just about the money0 -
Thats why I asked how much was the contract cost - that would give an indication of whether unknowingly or otherwise the purchase was clearance or not.0

I bought a "clearance" mobile on the CPW website. What I didn't know, as it isn't mentioned on the site, is that "clearance" from what I received means used. The phone arrived in a plain white box with a battery that was scratched, dented and even had a pen mark on it. When I ordered the phone I received a confirming email immediately. 24 hours later I got another email, that looked like one anybody could knock up, charging me another £10 for airtime I hadn't ordered. Let the fun and games commence.
The first person I spoke to promised I would be refunded; I wasn't. The next person I spoke to gave me a direct number; when I rang it, it didn't even ring. The third person promised someone would ring me back..........well you can guess the rest. Meanwhile every email I sent to them is currently unanwsered. I emailed the CEO to be told by his staff I would get the £10 back within 28 DAYS by CHEQUE!
My basic points are these;
1. They took an un-authorised payment from my card.
2. I will have to wait 28 days for a refund, if I get it.
3. "Clearance" meant USED.
4. They have yet to return calls or emails.

People do purchase items without realising the implication of the word "clearance". The effective cost per month (after any cashback) can sometimes indicate whether an item was refurbished or not.
The fact that it came without original packaing would seem to suggest its a clearance phone which mobiles.co.uk could say was "brand new" under their wording. So did Allan know or did not know it was a clearance phone - I do not know. Its down to judge to decide if it gets that far.
There are two cases to this problem -
1. the water damange which is likely to be user fault and very difficult to prove otherwise.
2. Was the phone refurbished or not - that depends on what was purchased in the first place (a brand new phone or a brand new phone sold as a clearance deal, the latter seems to be the case given the original packaing was not present).0 -

DAMN!! I would never have realised clearance could be code for returned and refurbed!!
I suppose we're stuck in the situation we're in then?
The only glimmer is the Email which stated specifically that the phone was 'brand new stock, not a refurb':mad:0 -
Would not make any difference if it was new or not if it is now water damaged.
Might be worth getting a cheap battery from ebay and try it in the phone - you might be lucky if its only battery thats gone.
Plus there are usually two stickers to indicate water damange, one on the battery and one somewhere under the battery - worth checking both.
If it is only battery that is gone, try a replacement battery as above. Still no luck then send it to samsung to repair as its still covered by warranty (the phone). Put new battery in before sending it to them.0 -

Don't worry, your not the first to buy a dodgy second hand phone off them in the guise of clearance stock and no doubt you won't be the last

Sorry that I've only just seen this thread; if you purchased a Clearance deal then, as per the big "What is a Clearance Handset?" graphic on all Clearance handset pages it will have been refurbished after being returned by a previous customer.
Apologies that someone has told you that you had a brand new phone - without seeing your emails I can't really comment but I'll make sure everyone in CS is fully aware of what the difference between brand new and Clearance is. In any event though we would not have supplied a water-damaged handset and unfortunately this is not covered by any warranty, whether the handset is clearance or not.

Could you please explain to me why a 'clearance' phone, regardless of whether it is from surplus stock or indeed a customer return would be packaged in non retail packaging?
Not only has this meant that the phone in question was not supplied with the software necessary to link it to a PC, but also that any future resale value after the end of the contract is severely affected.
I am sure that the 14 day money back guarantee would be subject to the phone being returned in its original packaging, so where does this go?
Surely it costs more to have a supply of alternative boxes to use when the original packaging comes from the manufacturer?
I would be grateful if you could answer this query here so other members can read it too.0
