Will digital pics of the phone be acceptable?
I understood what I meant but realise I was jumping forward too fast without explaining :rotfl:
What I mean is that you have an email saying they have charged you for a "Brand New" phone which is what you were supposed to have received.
You actualy received a refurb of which you have no idea what the history is ie it could be repaired or returned or demo stock etc etc.
You know it was a refurb because it came in refurb packaging (you have now found out) and it was recognised as such by a guy at T Mobile and there are stickers etc on the phone which indicate it too.
Had they have said it was a refurb in the beginning there would not be a lot you could have done regarding the water damage etc.
Had you known it was a refurb you would have checked it more carefully etcIt's not just about the money0 -
Ooops - sorry I forgot about the "refurbished" marking - so there is a case to be answered.0

At the end of the day, all we want is a phone that works.
If we paid for new, cant we expect new?
I know its a long way down the line, but if we were given no reason to think otherwise, why would we check the phone in any way more than 'it works as it should'?
I would have thought that the onus is on Mobiles.co.uk to prove it WASNT a refurb rather than us to prove it was?
And presumably, the info written on the sticker can be traced to prove it was indeed put there before we got the phone?0 -

I ordered a mobile phone which arrived in white box, but I think it was because it was a sold as ''clearance'".
Learn from the mistakes of others - you won't live long enough to make them all yourself.0 -
Not a lawyer myself, but if I was opposing your case then I could say the writing on the sticker could be forged. Its your problem to prove its not.0

Allan, how much was the contract cost? That might give a clue as to if it was a clearance phone or not.0 -

A witness that states that in his opinion it looks like a refurb.
And a few pics of the stickers that are in line with those that are present on other refurbs etc
Maybe a witness that states they were always there etc.
But isn't all this going a bit farIt's not just about the money0 -
Even so, clearance handsets can be sold as brand new under the wording here
