I really should smack myself up the side of my head! dont know why i didnt think of this before cos this is what i do!!! collect up the ciggy butts - but dont put them in bin (I was told this tip by a bloke who ran a psychic centre and did organic gardening and was self sufficient) and put them in large bucket of water. after couple of months of steeping, drain them off. resulting liquid can then be put into spray bottle and used to clear roses etc of greenfly - they hate the stuff!!!!! so you can send him thank you note for supplying you with FREE roseclear!0

OP, you've had lots of suggestions and advice now, what are you thinking your course of action is going to be?
Any more from then, I will have no option but to persuit it through whatever legal channels are available to me. I am not sure how to go about ASBO's or complaints to which council dept (or if it is through the Police), that I have to apply to.

sorry marleyboy - i must have misremembered your post as you saying he also smokes outside and it drifts into your house......
I should point out Ironically that I was the Non Smoker who supported the Smokers stance on smoking in a street where traffic pollution was just as bad.

I don't know why you don't collect them all up for a couple of weeks, then when you've got nice big pile, toss them back on his precious garden. Make sure you sprinkle them all the way down the fence, so they're not in a nice easy pile for him to sweep up. You get extra points for letting him see you while you're doing it0

The police won't be interested unless you start throwing ashtrays through his window or get the local heavy to beat him up as someone suggested.
You need to contact your local environmental health department of your council. Explain to them this has been going on for a while and you have talked to them endlessly and they refuse to stop. I would only look at the ASB unit if environmental health can't help. The police wouldn't really be interested and just tell you to contact the council.0 -
I have decided for now to collect the stubbs for a total of 1 week, storing them in a plantpot, by Friday of next week I intend to take them all to his door, and point out this is 1 weeks worth of his stubbs, I thought I would return for him and ask him (again) not to deposit anymore in my garden. I will also inform him from that point onward I will be collecting any further stubbs to be used as evidence for the relevant authorities to deal with.

I am wondering if,just as a precaution,it would be prudent to let the relevant authority know of your intended action,so that should he decide on another different type of harrassment you will have it on record that you tried to resolve it.0 -
Why not just tell him that you'll be returning his 'lost property' by posting it through his letter box daily? I've done this with dog owners who let their pets carp on my front lawn, works a treat.0

marleyboy - the reason I have tried so hard to help here is that i REMEMBER you from the anti-smoking thread as being one of the few who seemed sane and reasonable. your neighbour sounds like a lonely old git who has too much time on his hands and a dislike of neighbours (feel free to correct me if I am wrong) and I really would like to know if previous owners of your house had probs with him as this could affect the way you need to deal with him.0

I really cant understand why he insists on doing this, its not as if it is accidental, this is a deliberate act
My first thoughts are, he's either trying to annoy you or he does not want evidence of his smoking in his garden.
I know you said the house was privately owned, but is it owned by him? Many people buy houses and rent them privately. And many stipulate no smoking.
I think he doesn't want someone to know he's smoking in the house, maybe his landlord, maybe his wife.
Does he actually open the window and lean out to smoke, or does he just open the window to throw the butt into your garden?0 -
What seems a silly little problem can escalate so quickly especially in todays violent world, my advice is don't stoop to his level - he probably gets a sick thrill from winding you up, I would either go to the Citizens Advice Bureau or go & see a solicitor to see what you can do legally, its just a shame there are so many sad ppl about like this.Theres only two rules to remember1) Im always right2) See rule 10
