  • Thankyou everyone for your help. What happens if they do send bailiff's around.
  • They can't. To do so they would have to take you to small claims court (extremely unlikely) you lose the case (even more unlikely) then you fail to pay the court imposed penalty. Then and only then are Bailiffs involved. What the ppc's do is threaten with debt collectors who are no more able to claim money than you or I.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
  • The pillocks that they might send to your house are in house door stop collection agents. They have the same or lesser rights than your bin man. Dont let them in and politely (or not up to you) tell them to do one or you will call the police for tresspass.

I had a similar run-in with a debt a few weeks back. A company said they were visting on monday of this week, Guess what they never came. And never will.

Don't get confused with DCA's and Bailiffs, DCA's are scum appointed, Bailiffs court appointed.

    Nick is correct.
While talk of Bailiffs in a conversation about Private Parking Companies is slightly incongruous I should add a order to Nick's comment - and it applies to real Bailiffs.
Some have been known to declare themselves to be a "Court Bailiff" of "from the Court" when in fact they are not. These claims should always be checked.
  • Thnks again everyone. This site puts my faith back into people, helping one another for no gain.thanks
  • Hi John

I also have one from Euro car parks now passed to Control debt agency. Nothing has come of it, try not to worry about it

    xx
  • Got a letter from credit agency today demanding £78.75 with firm instructions to commence litigation and obtain judgement against me if I dont pay in 5 days.Do I ignore or ring them to say I will not be paying??
  • Don't contact them it only encourages them to send more demands. I would guess the letter was littered with "mays" and "intends".

Don't phone, don't write, don't call them. (Remember the song: "I love it when you call, but you never call at all").

The world won't end in 5 days, and in any case, it's the PPC not the DCA who would have to instigate court action. Which they won't.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
  • i've had a similar parking fine - i just ignored it and nothing happens

i think the fact that they obtain your name and address is very dodgy under Data Protection Act...
