I have info from the CAB on Mortgage Rescue and Lenders 'Deeds of Shortfall' which makes for interesting reading!
I can see this is not going to be an easy fight. I do know of one case where my lender had agreed to write off the shortfall so it can be done.
In this long process, not once was I told about the shortfall situation and what the banks would want you to sign. I understand they want to claw back as much money as they can, but I thought being bankrupt would protect you from that, I think thats why I am upset. Why on earth would a bankrupt sign to take on thousands of pounds of shortfall debt, having gone through bankruptcy which for us has been such a painful process? It was at the meeting with the HA that it was brought up. All the paperwork I have does not refer to a shortfall liability agreement at all. Thats whats been so frustrating, trying to battle my way through this, finding out as I go along.
And surely if you need to apply for MR in the first place its because you are in a vulnerable position, you face losing your family home, the upheaval for your children, the prospect of council temporary accommodation and in our case losing our beloved dog, because if evicted the council wont house a pet in temp accommodation. So what are you supposed to do, sign for thousands of pounds of debt on a limited income, where you are barely struggling to survive as it is. Thats the whole point of MR to protect and help vulnerable families to stay in their homes, not put them into major debt.
If we do ever get to the end of all this and stay in our home, then I want to take this further. I want the bigwigs to know what I have been through to make this happen because although I keep on fighting, the waiting and the stress of the unknown is taking its toll. The hurdles faced keep coming up, as soon as I have got over one, another one rears its head. My hubby is particularly low about it all at the moment and our lives are in limbo.0 -

Yes it is that document. Kindly forwarded to me by a contact in another local authority who approached me very early on in all this with help and advice. Got to thank this forum for that.

Morning, just a flying visit update as its my birthday today and hoping for a nice day to relax and chill!!
We have received the OFFER for the house from the housing association :j woohoo! Its a rather long document to read through and we have to wait for the 8 day cooling off period before we send back the form to say we would like to proceed, but im over the moon to finally have it 'on the table' at long last.
I will go into more detail later when I have a chance, but just wanted to share the good news about my progress with the mortgage rescue, oh and if it all goes ahead we will be the first in my area to have got through it.
